fraudulent inducement.
FSU's lawsuit touched on elements here with regards to Swofford and deals he was cutting that did not have the necessary transparency at the time, thus providing members with potentially compromised information from which to make the decisions they did leading to this current agreement.

If a school didn’t, they would have been booted out of the ACC. And that was back when the ACC actually mattered a little. So it was understood that to be a member, a school had to sign away its media rights. When the conference ceased its fiduciary duty to its members and drastically mismanaged its moneymaking potential, it rapidly became irrelevant. It’s time to go!
Why didn’t they fight for better media contracts as strongly as they go after their own members?! It’s unconscionable the way ACC brass is treating FSU and Clemson. Clemson tried to play nice, but was rebuffed like a jealous lover. Time to take off the gloves, throw down, and start really landing some haymakers! No holds barred now!

The ACC is going down. They have not acted in the best interest of the league members. They have shirked their fiduciary responsibilities to the league members. That's illegal.

The fact that we are so far behind these other conferences, and the ACC is doing nothing about it, shows either a lack of competency, nerve or ethics. Pick one. Don't care. Swoffie, nor our current effigy, show any reason to believe anything will get better. As much as I despise the idea, it's time to go.

The suit doesn’t dispute the fact that Clemson signed and is bound by the GOR. The argument is that the conference’s interpretation of the contract is incorrect. Specifically, regarding the broadcast rights of games once an institution is no longer a member of the conference. Clemson’s position is that the GOR protects the rebroadcast rights of Clemson’s ACC games, but not future games played in a new conference because those are no longer subject to the ACC’s obligations under the ESPN Agreement.

Exactly GSTiger! It's all about the broadcasting rights. It's not about what each University signed. Evidently there's some wording in the contract that's different than what's in the ESPN agreement with the ACC.
Sounds like this may be Clemson's way out!

Clemson will always be a top Football destination regardless if we win it all or don’t make the playoffs!

Clemson will be playing football in a new conference by 2025. The ACC teams will lose revenue if they don’t leave. Clemson and FSU football have a lot to sell. I am not so sure about some of the other teams.
