The Biden administrations is required by a 1997 lawsuit settlement to provide these provisions to immigrant children. Guess who else had to do it? Trump. Obama. Bush. Clinton. In fact, while Trump opposed it, he followed it. So show your outrage there, too, MAGAophiles.

I've linked the WaPo article explaining it, but here are the key details for those who struggle with the reading a little bit:

"At issue is something called the Flores consent decree, which began as a class-action lawsuit regarding the treatment of migrant children. The Justice Department negotiated a settlement in 1997 during President Bill Clinton’s administration.

The Flores settlement requires the federal government to release rather than detain undocumented immigrant children, first to their parents if possible, to other adult relatives if not, and to licensed programs willing to accept custody if no relatives are available. A 2015 judicial ruling then said the Flores settlement covered all children in immigration officials’ custody, regardless of whether they were apprehended crossing the border alone or with family.

Here’s the relevant section of the settlement, which refers to the now-defunct Immigration and Naturalization Service (INS).

Note the reference to food: “Whenever the INS takes a minor into custody, it shall expeditiously process the minor and shall provide the minor with a notice of rights, including the right to a bond redetermination hearing if applicable. Following arrest, the INS shall hold minors in facilities that are safe and sanitary and that are consistent with the INS’s concern for the particular vulnerability of minors. Facilities will provide access to toilets and sinks, drinking water and food as appropriate, medical assistance if the minor is in need of emergency services, adequate temperature control and ventilation, adequate supervision to protect minors from others, and contact with family members who were arrested with the minor.”

A 2015 Customs and Border Protection (CBP) document laid out national standards for transport, escort, detention and search processes. These standards are derived from the Flores settlement and a 2008 law that codified elements of Flores, the Trafficking Victims Protection Reauthorization Act.

Among those standards: “Food must be appropriate for at-risk detainees’ age and capabilities (such as formula and baby food).”

We mentioned that Trump was no fan of Flores. He tried to get rid of it but was blocked by the courts. So he followed the law, too. “We also observed all Border Patrol stations had food, snacks, juice, and infant formula available for children,” said a 2020 Department of Homeland Security Inspector General report on how the administration struggled to manage the 2019 migrant surge.

Great article from the Atlantic; this provides important context for much of the baby formula problem.

But (as with any complicated problem re: baby formula shortage), there is still more context to consider.

Context takes time to understand, so this is another long post.

(1) Milk production in USA for 2022 vs. 2021 is forecasted to decline slightly (link below).
(2) Babies of US citizens ... slight decline (2020 vs. 2019) by ~ 150,000
(3) Babies of illegal immigrants ... est. per year of ~ 300,000 (Note: Precise numbers are difficult to generate)
(4) We are also sending a lot of baby formula to the Ukraine. (This is fine, but other bad gov't policies had contributed to the baby formula shortage BEFORE the UKR situation came into being.)

(*) Mild production is down; number of babies in the USA are up. Tinkering with the economy via 'politically correct' policies has consequences, and has played an important role in current the baby formula shortage.

Center for Immigration Studies (March 29, 2022) "Estimating the Illegal Immigrant Population Using the Current Population Survey"
Summary: Data shows number fell from 2019 to 2021 but rebounded by more than one million by early 2022

Center for Immigration Studies (Oct 9, 2018) "Births to Legal and Illegal Immigrants in the U.S."
Key excerpt: In 2014, one in five births (791,000) in the United States was to an immigrant mother (legal or illegal). Our best estimate is that legal immigrants accounted for 12.4 percent (494,000) of all births, and illegal immigrants accounted for 7.5 percent (297,000).

(*) Declining milk production (with milk being the primary source of whey and casein as the majority ingredients in baby formula) is forecasted. Poorer quality and lower yields of key feed grains is forecasted; a big component of the poorer quality / lower yields in 2022 is the current shortage of nitrogen fertilizers due to capacity constraints of the railroads to transport N fertilizers from mfg'ing plants to the key grain growing regions of KS, IA, NE, (I forget the few others).

(*) Greenies will hate this, but it's true: The USA's back-and-forth policies over the past decade have contributed to the current shortage of rail capacity. Railroads still carry far too much crude petroleum; if pipelines (including Keystone XL) had been built without the constant interruptions, then some (not all) of the crude carried by rail would now be transported by pipeline.

The broad economy is complicated. Gov't driven factors (increased illegal immigration for high birth rate people / premature 'green' initiatives which create transportation shortages) have contributed significantly to the current baby formula shortage.

Even when Abbott fixes their listeria or whatever their bacterial infection problem is, the USA will be facing other food shortages due in significant part to 'politically correct' policies instead of practical 'let America function without excessive gov't interference' policies.
