I understand the dynamics. I can also guarantee you a lawsuit is coming, and body cam footage will be pulled. I wonder if the minimum amount force was used to control the situation. I guess we will see. Yes, I am a huge supporter of the blue, but I can't see this going in blue's favor.

This should be cut and dried. If the police gave a legal

command, and the band director failed to comply, and subsequently resisted detainment or arrest, or assaulted the police, the police have done nothing wrong.

If the police just walked up and tased the guy for no reason, then they should be fired and charged.

I understand how it works in the real world, and that it will be twisted by every side. Too many cops over react and abuse their power. At the same time, too many citizens have no respect for our laws or the people who enforce it, and don't feel any obligation to obey either; they don't like anybody telling them what to do, and they feel justified in resisting, fighting, and fleeing.

It shouldn't be that hard to determine who was wrong here.

I hate cops. Bunch of liars and manipulators.

Sep 20, 2023, 2:43 PM [ in reply to Re: He pushed a cop...got tased...*** ]

Why is it legal for them to tell you whatever they want during interrogations? They can just lie and say we have your fingerprints even if they don’t… just to get a confession.

Cops are the worst, at least most of them. I will never trust one ever.

I wrote a song about the Day the Music was Tased

4

Sep 20, 2023, 12:07 PM

(Verse 1)
A long, long time ago, I can still remember
When our band director led us all the way to the top of the pile
But something changed on that fateful day
When he got tased in a shocking way
And we all watched as he went down with a smile

(Chorus)
Oh, the day our band director got tased
We were all left in a state of daze
Singing, "Bye, bye, Mr. Conductor, why'd you have to go away?"
We'll never forget that electrifying day

(Verse 2)
Well, the band was playing with all their might
In the football stands on a Friday night
The crowd was cheering, the energy was high
But little did we know, the end was nigh
As our conductor waved his baton so proud
A sudden shock, he cried out loud
And the taser's jolt sent him to the ground

(Chorus)
Oh, the day our band director got tased
We were all left in a state of daze
Singing, "Bye, bye, Mr. Conductor, why'd you have to go away?"
We'll never forget that electrifying day

(Verse 3)
We rushed to his side, a worried crew
As the paramedics hurried through
He said, "Don't worry, it's just a little shock
I'll be back leading you, around the clock"
But as we waited for the ambulance's ride
We couldn't help but wonder deep inside
Would our band director ever be the same?

(Chorus)
Oh, the day our band director got tased
We were all left in a state of daze
Singing, "Bye, bye, Mr. Conductor, why'd you have to go away?"
We'll never forget that electrifying day

(Verse 4)
Now, years have passed since that shocking night
Our band director's still in the spotlight
But he's got a tale to tell, a shocking twist
About the day he got tased, we all insist
And as we play on, we remember well
That night we all thought we'd say farewell
But our conductor's still here, leading the way

(Chorus)
Oh, the day our band director got tased
We were all left in a state of daze
Singing, "Bye, bye, Mr. Conductor, why'd you have to go away?"
We'll never forget that electrifying day

(Outro)
So here's to our conductor, strong and true
For surviving that shocking debut
In the annals of band lore, you'll always stay
The one who got tased and lived to play

There is no greater supporter of Law Enforcement then me. I just wonder if this incident really had to escalate to this level at a High School Football game. I am not saying the officer(s) were wrong, I don't know the facts and it is unfair for me to judge the incident based on what little I read. However, fighting words cannot be used to arrest an individual in South Carolina, but I don't know about Alabama. Disorderly Conduct is usually a charge that is used when you get pi$$ed off and don't really have anything else to affect an arrest but you feel he/she needs to go to jail. Disorderly Conduct is kind of that fall back charge when nothing else seems to warrant an arrest, but you want the individual to go to jail or suffer some type of consequence for their actions. Now, if the band director was assaulting the officer, then maybe a tase was warranted to gain control and maybe the tase was the minimum amount of force used to control the situation. If the band director was being mouthy but still moving along after the final song, then the officer probably should have let him be mouthy if he was starting to leave the area even if he was doing it slowly. Now, if the band director simply pushed the officer, then the officer had every right to make an arrest for assault. Officers are justified to use force if they follow the proper Use of Force Continuum. Verbal direction and open hand techniques should be used before a taser, unless the band director was in a position to cause great bodily injury, then the officer is justified to go one level up from the perpetrator, and maybe they were, we don't know the facts yet. Most departments use the 1+1 use of force continuum, and the officer has the right to go one level above the perpetrator. Obviously, the amount of people and the crowd also play a role in a use of force. However, was there opportunity and jeopardy? Was there an opportunity for the band director to cause great bodily harm and did he have the ability to do so. If yes, then intermediate weapons should be used. If no, then it is a bad use of force. Other things play a role too, how many other officers were present? Could multiple officers control the band director without the need for intermediate weapons? Did the officer feel other bystanders may get involved? Body cams should reveal if it was necessary.

I just find it to be an interesting story. I feel certain the band director was being a smart a$$ but even when less than lethal force is used, in this day and age, you better be able to justify it. Hurtful words and even fighting words are usually not enough. If he was being mouthy, and maybe even acting disorderly, but was somewhat beginning to pack up and exit like he was told to do so, then I am not sure it needed to escalate. However, if he came down from the stands aggressively and became physical with the officer and showed no signs of retreating, then force would be justified. Watching the video over and over and over again, it was obvious the band director was animated and was pi$$ed, but I just don't think the taser was warranted.

I am 100% pro law enforcement. Blue has a tough job. Sometimes though, officers can get tunnel vision and lose focus as well. Sometimes it is better to let a smart mouth a-hole talk his crap for a few minutes before an escalation occurs.

Just my opinion.
