They can charge anyone at any time for that. It's like a disorderly conduct charge. Sounds like harassment to me.

Doing 26 MPH over the posted limit of 70 MPH just outside of St Matthews on I-26 East would result in a 6 pt, $300 ticket and no jail time. A court date appearance was helpful in reducing that to 2 points and $150.
