you can not fly directly over people who are not protected by a roof, can't fly near airports and stadiums, government buildings, not within 2000 feet of a cloud, and not above 400' AGL unless near a structure,. etc.. You CAN fly over any private property and people do not own the airspace over or their homes.

If they passed no laws, then we already have a legal surveillance state with drones. The p[police could just say they were filming something else and caught you in the act of committing a crime. No attorney tho.

The Chinese make most of the consumer drones sold in the US. They can be set into an intelligent fight mode that follows anything you circle with your finger on the screen, car, boat, or person. They can be ordered on Amazon. You can have one on your doorstep on Monday and need no license to operate one as a "recreational pilot".

The Patriot Act was passed using domestic ‘terrorists’ as the Apple in which the hidden razor blade of ‘terrorist can be defined as anything the govt wants it to mean’ was hidden.

Look at how the descriptor ‘near’ can be defined according to the govt surveillant’s wishes.

If the intent was to pass a law that protected the privacy of Americans instead of to codify spying rights of the govt on civilians, then the foundation of such a law would be ‘surveillance via unmanned device is not allowed on private individuals without prior court order, and said surveillance can last no longer than 24 hours unless a second court order allows for a subsequent period of no longer than another 24 hours is approved.

Flying a drone over private airspace at levels no less than 400 ft AGL is permitted, but no surveillance can be conducted. Any incidental evidence obtained by unmanned surveillance over property(s) which had not been defined in the court order is inadmissible.

Yada yada yada …

This is the spirit in which unmanned surveillance laws should be written / modified.
