Question for the highly respected board.

I have the confuse. It is reported that the schools (Clemson, for example) has no part or dealing with NIL distributions. Money offered to student athletes come from businesses or whatever. But yet, some report on here that Dabo does not offer NIL $$$ until they have proven themselves. How can both of these things be true?
Please excuse if this has been brought up before but I tend to lurk for answers before I pst a topic.
TIA

The “school having no part of it” was BS to make it seem a little less sleazy. Everybody knows it’s pay for play

That's backwards from reality.

The "sleazy" was the NCAA and their athlete exploitation. There is no sleazy with NIL. It's just business sgreements.

Other than funding/inking the agreement, schools/coaches control NIL

School oversight Each school has the authority to review and approve NIL deals for their athletes. Schools can also object to deals that conflict with existing agreements. Coach involvement In 2023, the law was amended to allow coaches, schools, and teams to facilitate NIL deals for athletes. Athlete responsibility Athletes are expected to understand their school's NIL policy and keep their school informed of all NIL arrangements.

NIL deal is between the athlete and entity. Elon Musk could pay an athlete whatever just by having them appear in a Tesla commercial. Nothing a school can do about it.

I’m asking a rhetorical question, sorta, but where does all the crap about Dabo not offering $ until they have proven themselves come from?

Ifg you think the NIL money distributors are not colluding with Dabo about it, I have a bridge I would like to sell you - 20% off.

Who's going to get that money at Clemson? Will it be an existing player or possible transfer that hasn't proven a thing at Clemson. If Musk wants to give the money to one specific player, it's his choice but if he's a transfer, it won't be at Clemson.

That was included in a draft of the House vs NCAA settlement. Problems with that clause put the settlement on hold.
That clause violates the Sherman Antitrust Act, the injunction in the Tennessee/Virginia vs NCAA case, and if the athlete is from out of state, the Interstate Commerce Act.
Private NIL cannot be legally restricted or interfered with by third parties (NCAA, schools) without an antitrust exemption.
