Sirrius hypothetical question.

Let's make the wild assumption that Joe wins on 11/3. Let's say before he is sworn in he is indicted and forced to resign.
Does the office then go to Kamala (remember, no one has been sworn in at this point) or does the decision revert back to Congress? Or does the SCOTUS decide? Or does DJT Trump laugh his way to 4 mo years?
My Constitutional knowledge wants to know.

I have no idea what law says, but I would guess since he never took office that Kamala does not automatically get promoted to POTUS.
But, who decides is your question? Dunno, but would be interesting to find out.

He'd have to be investigated, indicted, and convicted all in under three months. Considering there's not even an investigation or any supposed crimes, it's a pretty unlikely hypothetical.

First of all, indicted for what exactly ??
Secondly, the Electoral College votes in the 1st week in December (I think). It would seem to me that once that is done, Biden and Harris would be official. If the EC has NOT voted, then there is a whole other can of worms about each state's rules about how the EC delegates have to vote (that would be a real mess)
Can the President be indicted ?? The Trump administration has said no.
Even, in the far-fetched scenario that Biden WAS indicted, that would have no impact on VP Harris.
