settlement so what can be so bad in a contract that made them give up so much just to keep the contract from becoming public knowledge??? Inquiring minds want to know! Great day for our Tigers though!!

becau­se the ACC mislead (if not outright lied) to league members and colluded with ESPN, they knew they were in an untenable position, and the last thing the ACC and ESPN wanted was for that information to become public knowledge.

Thankfully, FSU and Clemson had the backbone to challenge the league while other conference members were content to sit back and let the ACC continue to sodomize them.

I suspect collusion was more a conspiracy to commit fraud.

Imo, Clemson didn't want to get tangled up in a long court trial. I believe fraud was committed and those guilty need to face a judge.

When they get in the huddle at the football are you always complaining that they are talking about you! Our lawyers read, approved and the president's of the universities read and signed and approved it long ago! Where have you been! All done twice...when the SEC and big? Contracts followed they were much more lucrative (more butts in seats) us & the savages got mad! ITS OVER!

Why is it always the low Tiger pulses that take the side of the ACC or ESPN? Could it be because it really helps the team they truly like (not the Tigers)? It is consistent negativity from these people.
It seems they would be more happy elsewhere, rather then stirring stuff here.

A majority here seem to hate the ACC, ESPN, ABC, etc., and have decided that these entities hate Clemson and have conspired to undermine our athletic programs (especially football).

The reasons for this supposed collaboration to harm Clemson range from jealousy over our football success to animosity over our Christian head coach.

I have yet to hear an explanation for why the media is supposedly against us, despite us being a successful program that is good for ratings. I have also yet to hear a reason why the ACC has it out for us, considering the fact that our athletic success (especially in football) has helped the conference's reputation, value, and bottom line.

But alas, the hatred and vitriol - and constant negativity - for the above entities persist.

Judge, I have no vitriol about it. The ACC made a bad long term deal with ESPN. Swofford would have been better served with a shorter contract, but the only way to get the ACC Network was to sign a long term deal. But he bet on a dying industry, cable TV.

The problem I have with it are twofold- First, Clemson and FSU were lied to by the commish to agree to the deal, and it was signed by the commish without full disclosure to the schools what he was signing on for in their name. That was part of the basis for the lawsuit. Second, these schools are being devalued to carry the weight for an entire conference that puts all efforts into basketball. This is not sustainable, and eventually the two stalwarts will falter as they will not be able to compete in a system where the athletes are paid.

Clemson and FSU had two options- sue to end the contract or accept a future as second rate football teams.

From what I have read, there is no evidence to suggest that the ACC lied. Therefore, saying that they did is conjecture.

Second, you said that the ACC puts all of its efforts into basketball. What on earth does that mean? The ACC promotes football a great deal, but like all conferences they must also promote every sport to some degree. Still, there is no evidence that the ACC doesn't care about football or de-emphasizes it somehow.

The bottom line for me is that the ACC includes a lot of member institutions that do not have the resources to devote to football in this current era. Asking smaller schools like Boston College, Wake Forest, etc. to have the alumni backing and NIL resources to compete at a high level is unfair. They are unlikely to ever be able to do that like Clemson and Florida State do, or like most SEC and many Big 10 schools do. That isn't the ACC's fault.

While I don't think that the ACC is perfect by any means, it has been a great home for Clemson. We have had outstanding success in our athletic programs, and the ACC is partly why. Moreover, we have done what we needed to do in order to hire the right coaches, raise funds, and ensure that we are not over-reliant on the ACC for our success. That's how it is supposed to be.

I am all for Clemson and Florida State getting a bigger piece of the pie financially since we directly influence the money that comes into the conference, but I hope this is a lesson to both schools that you never sign a long-term agreement that makes it nearly impossible to get out. It was a ridiculous decision that was blindly made in the name of "conference unity," all out of fear that teams would bolt. You can't do that because it unnecessarily ties YOU to a situation that you might prefer not to be in.

Well, we know that the ACC/ESPN were not willing to go through depositions, so I think we are all smart enough to draw our own conclusions on this. They were scared for a reason, certainly.

... as a layman and a fan of FSU and Clemson.

The legal situation was very complex. It involved contract law. Specifically "grant of rights" which, according to the attorneys is relatively new and has little to no legal precidence for judges to rely on. Furthermore, the major disagreement was whether or not the ACC commissioner had the authority to extend the original agreement without approval by the members. There was also disagreement that when the original GOR was codified the commissioner was not forthright with the member institutions but instead created a very lucrative deal for his son (remember Raycomm?)

At any rate, Clemson and FSU both thought they had good legal grounds on which to challenge the contracts.

From the terms of the settlement, it appears they had very strong legal grounds.

1. FSU wanted for the GOR to end when and if they left the conference.
2. Clemson sued for that specific reason. They sued saying the GOR applied to them only while members of the conference.

There were other concessions made by the ACC in the settlemnt (unequal revenue distribution, e.g.).

But,FSU and Clemson both got what they were asking for before the suit. "We don't owe the ACC or ESPN one penny after leaving the conference."

Seems like the ACC was the one on shaky legal ground, and did not want discovery to take place, so they gave Clemson and FSU almost everything they asked for.

I think you got it right. There were misrepresentations and lies. On top of it all, the commissioner gets to sign for the entire league after lying to you about what he was signing.

Hardly a fold. The money is just divided differently, not new. As far as the GOR goes, the conference knows that no team to join another conference so changing the penalty amount is no big deal.

They folded because Clemson’s argument on the GOR prevailed. The grant of rights applies only to schools CURRENTLY in the conference. Rights revert back to any schools who leave as soon as they pay the exit fee. The GOR wasn't as ironclad as the ACC thought.

Who folded...we were to be out tight now and join the SEC...ain't happening...nothing now except what was already on the table...the ACC now has two members who think they are more important than everyone else...sure that excites some of you...sometimes we get what we deserve...hope not...karma is a *itch!

The ACC folded like a cheap suit. Full stop

If their GOR were ironclad and they had no fear of losing they wouldn't have settled. The talk has always been how air tight it is. I think Clemson's lawsuit asking for a judgement on the definition of the GOR is probably what made the ACC the most nervous. The timing of the agreement to settle shortly after the FL Supreme Court granted discovery is NOT a coincidence.

They didn't want discover and you can bet neither did ESPN/ABC

If one doesn't think the ACC folded its because they don't wish to see it.

The ESPN agreement had to be bad, and to find out what’s in it I think there should be rumors that are much worse than would be in the agreement so they tell us to “calm things down”.

Maybe something like:
* Annual allowance for high class escorts for ACC leadership
* portion of proceeds go to the SEC basketball for NIL
* Cayman Island offshore accounts
* Agreement to have Friday night games during state playoffs and major recruiting weekends (with no requirement made of the SEC)
* Kickbacks on what should be spent on the ACC network programming so that only “3 Day Weekend” runs instead of meaningful soccer, baseball, lax, or gymnastics.

For starters. I think at least one of the above is true. Any other good ones to throw out there?

.... made by Peter Collins, Chairman of BOT for FSU. He made the statement in August of 2023, 4 months before FSU filed suit. (The quote below is behind a paywall, so I can't link the entire article. But, I have permission to copy and paste this quote.)

“When I say we have a handle on the Grant of Rights, we understand the document very well,” Collins said in August 2023. “We understand our position on that document, we understand the legal argument in that document, we understand who the parties would be under that document, and we believe we have a very good handle on what our risks are under that document. And what our opportunities are under that document.

“That’s the least of my worries based on what we know. … We understand it. We have gotten a lot of counsel on that document. That will not be the document that keeps us from taking action. And I’ll leave it at that.”

Collins made those statements after Florida State and Clemson sent teams of lawyers up to the ACC’s headquarters to inspect the Grant of Rights and the league’s media rights agreement with ESPN.

Makes no difference...none of you sewers were on the same page as DABO...he has spoken and when you read his comments find if you can anything you greedy, jealous 1/2 Tigers have in common we with Dabo.He has the heart for Clemson and the will and brains to do something about it, while most of you were and are merely COOT wannabees!
