Well well well. Notch another “W” for the MAGA conspiracy theorists who repeatedly assertEd that Georgia’s election in the 2020 races were seriously flawed? Looks like the federal judiciary agrees. Dominion voting machines are involved; the ease with which Dominion machines can be tampered or made to yield incorrect results appears to be a key aspect to this case.

Atlanta Journal Constitution - Nov. 13, 2023. “ Federal court order for trial regarding serious flaws in GA’s election processes”

Federal court, after evaluating State of Georgia’s election processes starting in 2017, decides that evidence of lack of election integrity merits a jury trial. Federal judge Amy Totenberg (an Obama appointee) issued this court order on Nov. 10. Trial date is Jan.9th.

CIVIL ACTION NO. 1:17-cv-2989-AT Plaintiff, v. BRAD RAFFENSPERGER, et al., Defendants.

OPINION AND ORDER Introduction This election case is currently before the Court on the Defendants’ Motions for Summary Judgment. [Docs. 1567, 1568, 1571]. Elections are contentious matters. So too are election cases. See Bush v. Gore, 531 U.S. 98 (2000). But the central issue in this case is not about partisan advantage, nor is it about how the winner of any specific election should be selected or why a particular group of voters or candidates have allegedly been favored over others, and it does not involve allegations of fraud. (Citation) Cf. Jacobson v. Fla. Sec’y of State, 974 F.3d 1236 (11th Cir. 2020); Wood v. Raffensperger, 981 F.3d 1307 (11th Cir. 2020).

Instead, this case focuses on whether Georgia’s statewide electronic voting system, as currently designed and implemented, suffers from major cybersecurity deficiencies that unconstitutionally burden Plaintiffs’ First and Fourteenth Amendment rights and capacity to case effective votes that are accurately counted.

Since its inception, this election case has gone through multiple stages of evolution. Plaintiffs have raised challenges to both the original, critically outdated Direct Recording Electronic (“DRE”) voting system and the current Dominion Ballot Marking Device (“BMD”) system that replaced the DRE system several years into the case, starting in 2020. A plethora of new factual and legal developments emerged along the way, topped off by the breach of the Coffee County election system in early 2021. This breach and the copying and sharing of election system software and voting data to actors and entities inside and outside of the state, as well as through the internet, bear serious ramifications for the future vulnerability of the State’s election system as a whole. Plaintiffs initially discovered this breach in 2021 and, thereafter in 2022, conducted a series of depositions of individuals involved in the breach, some of whom were indicted in the pending RICO criminal case in Fulton County Superior Court. See Georgia v. Trump et al., 23SC188947 (Fulton Cty. Super. Ct. Aug. 14, 2023). local offices in off election cycle years. O.C.G.A. § 21-2-300. Absentee ballots are processed and tallied on county electronic scanners, which are also provided by the State. 2 The Court notes that the record evidence does not suggest that the Plaintiffs are conspiracy theorists of any variety. Indeed, some of the nation’s leading cybersecurity experts and computer scientists have provided testimony and affidavits on behalf of Plaintiffs’ case in the long course of this litigation. The GA election management protocols, the ease with which Dominion machines could be corrupted by multiple ‘points of entry,’ the inability to audit the quality (I.e., acidity of the ballot selections) of the data, the State of Georgia’s refusal to address these issues after the 2016 election, and the worsening of the vulnerabilities of the overall GA Election system by the time that the 2020 election had taken place are the basis of the court case.

Since a credible overall audit cannot be conducted, it is impossible to prove that either Biden or Trump actually won the election.

That the State of Georgia was so incredibly negligent (this is the generous assessment of Team Raffensperger) with respect to their election process will be established as of the end of the case which starts in January.

That Raffensperger swore up and down that the GA election was conducted properly, and that Trump lost, reflects one or more from among (1) sheer stupidity,(2) shameful laziness, or (3) malevolent lies to cover up tampering in the election. Which from among these individual -or- combined factors is actually true? We’ll probably never know.

Regardless, Raffensperger’s dismissal of the Fulton County election center security footage, in which the water main ‘broke,’ election monitors were hustled out of the ballot counting room, boxes and boxes of hidden uncounted ballots were pulled out and ballot counting resumed … out of sight from the election monitors, cannot be separated from his assertions about the overall conduct of the overall election.

Look, you guys ‘won’ in that Biden won’t be evicted from the WH and Trump installed regardless of what gets uncovered over the next decade. Incompetency or dishonesty in the GA election not withstanding, Biden will remain in office until Jan. 2024 unless he dies before then.

All that this new State of GA case will prove is that MAGA was right; the GA election was not done right, and no one can say for sure that Biden won … or that Trump lost … in a viable election.
