Yes or no. Do you understand that under current law, those who cross the border illegally are granted due process, and those that claim assylum trigger another set of laws which grants them even more due process. And do you comprehend that this is what is backing the entire system up?

I understand that this is a stupid law which is perpetuating the problem and incentivizing increasingly huge numbers of people to risk their lives making the treacherous journey so they can enter illegally as well. It is a law that needs to be changed or rescinded immediately. In fact, it will have to be if the problem is to be addresssed. Now even Dems are having to admit the flood of illegal immigrants is harmful and something must be done. Fixing this law will have to be part of it.

Between January 20, 2021, and March 31, 2023, there were over 5 million illegal alien encounters. Of these encounters, at least 2,464,424 had no confirmed departure from the United States.
During the same period, DHS released at least 2,148,738 illegal aliens into the United States.
Only 5,993 illegal aliens encountered at the southwest border and placed in removal proceedings before an immigration judge were actually removed from the United States during this time.

According to both Biden and Mayorkas, the system is broken, and current laws act as a magnet, which help create the problem. So again, the laws are not any kind of justification for the problem they are acknowledging, they are the cause. We are letting people into the country illegally, then releasing them into the country for years and years. Any law that permits or incentivizes that is insane from the get-go.

(Researching immigration and asylum law is overwhelming. I tried and just concluded WTH.) The way around our existing laws are EOs which often get challenged in courts. Most agree that excessive use of EOs is detrimental because Congress by default is giving excessive power to the executive branch. In addition this leads to wild vacillation in policy from one administration to the next_ since policy by EO is not firmly supported in law. Congress needs to legislate instead of getting locked down in political muck. And btw, declaring things national emergencies is also a slippery slope and subject to wild swings in government policy and actions.

Is actually called the "Emergency National Security Supplemental Appropriations Act". It only included the border stuff when the pubs said they would pass nothing on Ukraine/Israel/Taiwan without new border legislation in it. Try to keep up, HTH.
