Read the UGA lawsuit and this may be a new twist to NIL...

the vehicle that was Jalen Carter was driving was a souped up street racer supplied by a Car dealer from Ohio. He didnt own the vehicle but was provided as part of his NIL deal. Per the lawsuit, the dealer knew of his driving record and previous tickets but continued to allow him to drive "their" vehicle. The lawsuit is coming after the dealer as well. Wonder if that will make NIL folks a little more aware of what they may be getting themselves into?

I hope so because it sure is ruining college sports.***

I suspect Ohio State will also launch their own

Investigation into why an Ohio dealer is providing NIL/vehicle to a UGA player 😉

No idea, but that’s a deep pocket. Interesting.***

I'm no fan of the Morgan and Morgan's of the world.

The people driving the automobiles were responsible for their actions.

But, on the other hand, there were other people involved. I don't know the legal terms but thing like "accomplice, aiding and abetting, complicit" come to mind. The people who gave the UGA employee the keys to the vehicle, the permission to drive the vehicle, etc. might ought to bear some responsibility.

Way too complicated a situation. We don't know all the facts, I certainly don't anyway. The degree to which others are at fault I don't know. But, I'm not ready to say they bear no responsibility.

Every analogy breaks down, but something like a bartender serving drinks to a guy he knows is too drunk to drive and then the guy goes out and gets in a car and kills someone. Or a guy who gives a friend a gun knowing the guy is mad at someone and is going to confront him, etc.

Let's wait and see before reaching judgment.

It may be complicated but I dont ever see it coming to trial. If 1/2 the things that are alleged in the lawsuit are true, UGA will be exposed and the bad press will haunt them much like the Jan Kemp situation did back in the late 80s. This will get settled and for some big $$$. Not going to let too much light shine on Kirbys' Dawghouse.

In civil litigation...

provided there is permissive use, both the owner and the operator of the vehicle are generally named in any law suit. However, at the end of the the day, the company providing the insurance on the vehicle will defend the lawsuit and pay any judgement up to the limits of the policy.

Just a guess but because of the potential liability, I suspect this was a type of zero-dollar lease and the kid or his family was required to provide the insurance. Of course, that's just a guess. If that's not the case, I'm betting the dealership won't make that same mistake again.

That said, I will be shocked if this case ever comes even remotely close to seeing the inside of a courtroom. Because of the punitive aspects involved, which are significant, the defendants and their respective attorneys will be bending over backwards to reach a negotiated settlement.

A civil suit against an individual who has little or no wealth is not attractive to a lawyer. In those cases they would want a retainer upfront and the good lawyers don't work cheap.

They successfully go after bars that overserve people when they injure or kill someone after driving drunk.

This seems somewhat similar for both Georgia and the car dealer.

It’s my understanding it was a stock Jeep Trackhawk. That’s a stock off the line SUV from Jeep

May 10, 2023, 9:58 PM

It’s still 707 HP off the dealer lot with zero mods

2025 purple level memberbadge-donor-15yr.jpg flag link military_tech thumb_downthumb_up

I guess my point is it was a stock vehicle from a dealership

May 10, 2023, 10:02 PM

Not “fast and furious” stuff. I have an SRT and a 2021 Supra in the garage and they are both stock “cars” that anyone can go out and purchase

The dealer should not be liable. I imagine the player had what is equivalent to a zero cost lease. The car would have to be insured. Whether or not the insurance carrier pays the bill is another story.
