I get that malice is harder to prove, though I can't imagine a really good excuse for saying Hugo Chavez has risen from the dead and manipulating voting machines through telekinesis or whatever. Looks like there's also some legal talk about who was involved in the decision to broadcast all these false statements. Given how openly the anchors and producers were talking about how it was all BS, don't imagine there's a good defense there either.

That "no reasonable person would believe that what we said was true" defense doesn't, intuitively, seem like a solid defense in this lawsuit. Fox arguably did an enormous amount of damage to the company with the lies.

Dominion vs Fox News: Overview of Summary Judgement

Not a lawyer here … sharing some basics (via FindLaw website) about Summary Judgement:
When one party believes that there are no important facts in dispute, he will file a motion for summary judgment. A typical summary judgment motion has three parts. For the purposes of this article, let's assume that the plaintiff filed the motion, and that the defendant must now respond.
Part 1: These are the facts: First, the plaintiff will present a version of the facts. The plaintiff usually attaches photos, signed statements from witnesses, and any other evidence to back up their statements about the facts.
Part 2: This is the law: Next, the plaintiff will argue about the state of the law. The plaintiff's attorney will write up a memorandum that discusses the statutes and cases that govern the parties and attempt to convince the judge that, under the law, the plaintiff is entitled to win the case.
Part 3: Even if…: In the last part of the summary judgment motion, the plaintiff will anticipate what the defendant will argue, and will try to prove that even if the defendant is correct in her arguments, the plaintiff will still win the case.

From what I get out of this, motions for Summary Judgement are a typical tactic for both the prosecution and the defense. I wouldn’t get too worked up either way about it.

George Patacki was the Republican Governor of new York from 1995 to 2006. 2023 - 2006 = 17. dumbazz.
New York has actually been fairly split until the last few years, with the State Senate controlled by the GOP from 1992 to 2018.
But pretend you have a clue.
You get how the dumb redneck states have all gone solid red? That's how states like New York have now gone blue.

...it looks like Dominion won as to the element of falsity, which is not their whole case but it's an essential element. The remainder of their proofs will be determined at trial.

...and the problem of proving malice - which means, basically, they caused harm and said what they said even knowing what they were saying was false - is actually pretty easy to prove in this case because the Dominion lawyers have texts from inside the Fox News building by guys like Tucker Carlson himself proving that. Rupert Murdoch himself, when pressed on the stand, admitted he knew full well what the truth was but "had" to basically because he was afraid of his audience.
That seems as bad for the defense as anything the plaintiffs had on Alex Jones...and it screams louder than a shout that the plaintiffs had somebody high up inside the Fox building. I mean, when you've got Tucker's private texts and Rupert Murdoch's private e-mails, that's, uhm, large, and I think there's probably a real interesting story there. How on Earth did they even get those? And is being afraid to give your own audience the bad news a real defense?
It's telling Fox isn't even attempting a "we didn't know" defense. Instead their defense seems to be a First Amendment defense. In which case they may have already conceded malice, yes?
I know Tucker was really, really butthurt Dominion got and leaked his texts.
