Do we really need habeas corpus?

“Donald Trump's administration is "actively looking at" suspending habeas corpus - the right of a person to challenge their detention in court - one of the US president's top aides has said.”
“Stephen Miller, the White House deputy chief of staff, told reporters on Friday that the US Constitution allowed for the legal liberty to be suspended in times of "rebellion or invasion".”
https://www.bbc.com/news/articles/c0qgz18glljo
The last rebellion invasion we had was January 6, 2021.
Stephen Miller Is a dangerous anti American nutcase. I hope the Lord will strike down upon Miller with great vengeance and furious anger those maga who attempt to poison and destroy my brothers. And you will know his name is the Lord when miller and Trump are in jail.

If true, Congress should be "actively moving" to impeach AND remove Trump from office. There is no rebellion. There is no organized invasion.
If Trump were to do this, there would be a rebellion and it would be justified.
This is insanity.

Neither. I approve of the job Trump has done to secure the border. The reduction in the entry of illegal aliens is commendable and I approve of lawful efforts to deport illegals, but don't think it is wise to discard the Constitution in doing so.
If we are to adopt the policy of the ends justifying the means, then Katie bar the door.
I like the Constitution far better than Trump or any President and for the Administration to even consider revoking habeus corpus over a failed immigration and border security policy that has been an issue for decades, concerns me as an American first, a conservative voter who has never voted for a Democrat for President and as veteran.
We didn't get in this mess over night and it is folly in my opinion to trample over the Constitution to try to fix this problem.

No president would consider doing this in peacetime, but Trump is active considering it. This move from the Hitler playbook was supposed to come later, after he cripples the courts.

Suspension Act in Constitution allows for suspension of Habeus Corpus
May 10, 2025, 11:07 AM
|
|
The Suspension Clause is in The Constitution (see link); Suspension of Habeus Corpus can be rightfully be applied to Tren de Aragua & MS-13.
This is America’s only reasonable path to ridding ourselves if the criminal gangs that were de facto invited by the Biden Handlers Administration into America.
It has been used before.
Looking forward to the revised arguments on here that the Suspension Clause cannot be used except in cases of a formal declaration of war on the country from which the criminal invaders had come.

You have failed to provide any evidence of an invasion.
The United States of America is not experiencing an invasion.

An invasion in the sense of Iraq invading Kuwait back in 1990 is not necessary.
A guerilla type of invasion, with gradual increases in enemies to the American people reaching a critical mass in which the enemy forcibly takes possession of the assets of citizens and/or harms the citizens is an invasion, too.
As for the Biden Handlers Admin flying in so many illegal aliens, with guerilla enemy combatants imbedded in the immigration flights, we have two choices:
Either the Biden Handlers were too stupid to/ careless to root out the enemy combatants before putting them 8n the flights
-or-
Biden Handlers knew the criminals / enemy combatants that they were turning loose in the USA, which means they committed treason.

They saw it as an emergency when Biden was president and that is part of what Trump ran on.

not an “emergency.” Just like films being made elsewhere is not a “national security threat.” They just want to use those definitions so they can abuse their power.

I didn’t write or pass the Suspension Clause.
Neither did you.
Regardless of your and my activities, it is in the Constitution.

Having you openly call for the suspension of Habeus Corpus is ridiculous and frightening. It worries me what will happen when/if Trump actually tries this and what he'll do when the courts rule against him (which they will).

And even if habeas corpus needed to be suspended, which of course it does not, that would be congress' job, not the President.
This is just fascist maga-talk.

They have been violating it, but he hasn't officially suspended it. All Congress has to do is what they should have done when Shitzenpants declared an emergency - vote that there isn't an emergency. I can say this for Trump though: all this chaos probably means he hasn't sexually assaulted anyone lately.
