bulkheads have been banned in SC beaches since 1988. He built the wall in 2023ish. In order to build that wall or do any erosion work on the beach portion of his property, he would need to get a permit from SCDHEC. This was not done, therefore he was in violation of the DHEC regulations. Hence the fine and the requirement to remove the wall.

I'd venture to bet his contractor charged him extra to do it with no permits. No upstanding contractor would do that without proper permitting.

It obviously goes with the path of least resistance, and into the neighbors yard.
The funny thing is it’s not just beach towns dealing with this. People down on the battery downtown are doing a variation of this with flood gates.

The google maps "street view" shots from the nearby beach in 2015 and 2017 are far out into the water, but when you view the photo, there is a ton of beach.
That lot is near the inlet, gonna have erosion and gotta combat it, just cannot do it illegally and individually in a way that imposes harm on neighbors and without consideration of the environmental impacts.

The state has four (4) critical areas defined as:

Tidelands - all areas which are at or below mean high tide and coastal wetlands, mudflats, and similar areas that are contiguous or adjacent to coastal waters and are an integral part of the estuarine systems involved. Coastal wetlands include marshes, mudflats, and shallows and means those areas periodically inundated by saline waters whether or not the saline waters reach the area naturally or through artificial water courses and those areas that are normally characterized by the prevalence of saline water vegetation capable of growth and reproduction. Beaches - those lands subject to periodic inundation by tidal and wave action so that no nonlittoral vegetation is established. Beach/Dune System - all land from the mean high-water mark of the Atlantic Ocean landward to the 40 year setback line described in §48–39–280.

We do full delivery mitigation banks, PRMs and In-leu-fee all over US. SC we've been involved with almost every private bank and SCDOT PRM. We now also do native shoreline restoration and banking. We get these permits from FL to MD.
Contractor saw an egotistical/ arrogant rich furk and capitalized on it...my guess

I've read that case, agreed.
Since the Sackett, SCOTUS, case people on the coastal plain feel empowered...as they should. But this dude is probably going to lose, and lose biggly.
I was on the call with EPA/Corps yesterday about the upcoming WOTUS updates/guidelines for 2023 rul le revised or soon rescinded. This Admin has a chance at finally defining relatively permanent waters and continues surface connections...also truly codify WOTUS. Ditches will also be addressed.
