The pro sports teams have a single player’s union that bargains those rights with the pro leagues.
No union with collective bargaining power, no salary cap. It’s not legal.

earn as much money as he wants to via NIL, no limits, because that's the law and courts agree. However, the SEC, ACC, B1G, Big XII, Pac, and any Group of 5 league that wants to remain eligible for their conference title and/or a CFP berth could each set NIL caps for their respective programs to participate.
Jimmy Greenbeans is free to make $2 Mill off of NIL - he just won't be able to do it at ABCU because their NIL cap has been reached, but XYZU has room, so have at it. No one is stopping kids from earning NIL or setting a limit on what they could earn individually under this scenario. It just limits where they might be able to achieve that. Scholarship limits work the same way.

The NFL set up a salary cap to save on payroll expenses. I know they said it was to improve their product and the courts went along with it.
But the real reason for the salary cap is to cut payroll.

college kids dont have a contract other than the letter of intent. Michael Jordan made way more endorsing gatorade and nike than he ever did with an NBA contract.

Never without unionized college players.
9-0 SCOTUS decision says that sponsors can pay the athletes whatever they think they're worth.
Neither the NCAA or the schools have any legal recourse to get in the way without said union contract.

It will be a while.
They aren't even made public at this point. So getting a cap, is a long way from where we are now.
Wish we had it now; during the Dabo era.
I don't think we are done; if the TP and NIL can be "somehow" made a bit more equitable.

Yep.
If these kids are just basically; going to school to get on the football field: "stop the facade now"!
European countries have basketball and tennis academies!
They go to these places with the idea being; to eventually turn pro. "No facade of going for an education"!
This will have to be what ends up happening: "unless the NCAA steps up"!
They were too strict on transfers and making money - then they got way too loose. There was a happy medium i.m.o they could have tried before going this far.
