FSU case to go before judge in FL on April 9th.

That is after the ACC case goes before a judge in Charlotte.
I'm looking forward to hearing what attorneys on the net say about both cases. I have no idea. But, I will be shocked if either judge just rules in favor of one party or the other.
I have no idea how the final venue will be determined.

I just want to know the terms of the deal. I am pretty sure a collective of us T-netters can come up with a case to dismantle the GOR.

The meat of the suit has not yet been heard. Just wait until Swofford is deposed, along with his son and ESPN folks. All emails and correspondence subpoenaed. When that happens, Jim Phillips will fold like a cheap lawn chair. A settlement will be made. You can't screw over someone in a contract. Courts have ALWAYS recognized fair play and will always decide in favor of the plaintiff. It does not matter how many times FSU signed the contract. They were signing a contract that was unreasonable by any standard. The length and the fact that there was no clause allowing yearly or any other time period to amend contract based on inflation and other changing factors.
Sometimes the court has to step in and save you from yourself.
One way sweet heart deals just don't stand the test of time. FSU will prevail.

This may never go anyone being deposed...FSU agreed and signed all of it...you are not going to destroy the foundations of contract law for greed by an athletic department in disarray...if you agree with the FSU pipe dreams then go buy a car then take back for a refund and return of interest at the end of the year because the same car is cheaper,,,Ford will laugh you out of the showroom! By suing the ACC the injuns are in effect suing all of us as well...CLEMSON included!

You also can't profit from a contract for 15 years then decide you want more money so you destroy the contract and impute the integrity of everyone else including two CEO's of your own company! And seek to make everyone else look bad by using blog material, opinions and nothing original! Contract law, patent law, rules of evidence don't come from 60 minutes! The Sunshine Law does not Trump patent law and it will be known soon!

What can Swofford tell us that the FSWTC presidents cannot...let's see 15 years of board minutes from the FSU BOR...bet the emails and communications concerning this lawsuit will be doozies...given the SOL let's see the common from 3 to 5 years ago...when ESPN deposed the board and athletic booster groups who broke the contract that should be fun as well...proving that you have made less money now than if there had never been a GOR should be fun! Showing where the lawsuit originated should be a blast given that Fla. Sunshine laws apply there! It's gonna be a fun spring at FSWTC!

How could the FSU BOR allow the president of FSU (two different ones) to sign the GOR in 2013 & 2016 and just now when theSOL has long since expired start itching about it! Are they going to also sue the ex presidents and does the BOT review and sign all contracts! The farm outs were from ESPN to Raycom...not from ACC to Raycom...FSU is dodging this one...don't want to sue ESPN...if you look at all money earned from 2010 FSU may be sucking eggs! Why was there not angst about the GOR before the SEC & Big10 deals...bet the judge has seen simple greed and envy before! The state of Florida cannot change patent & IP law!

that specifies a location in the event of a trial, generally speaking, a defendant has the right for a trial to he held in its home state. The courts in a state have personal jurisdiction over all people or businesses that are citizens of or conduct business in that state. For example, you sue a South Carolina citizen in a South Carolina state court for breach of contract. It doesn't matter where you live or where the events leading up to the lawsuit took place.

I find this stuff interesting. But, I'm no attorney. It appears to me there are two suits, and each suit has the plaintiff and defendant switched.
So, which suit is more likely to go forward? Or do you think both will go forward?

From what I have been seeing I feel the NC judge will bow out based on judges not liking to interpret other states laws , such as Floridas Sunshine Law . If so I think that puts FSU in a really good spot and hopefully they leave the door open for Clemson to follow behind . I don’t think both lawsuits will take place

FSU put the sunshine laws to bed when they called secret meetings and board reviews without quorum, prior public notice or any of the other stipulations in the law...should be obvious to anyone keeping tabs that the football program and athletic department run the school...academics and degrees are secondary to buying a football team...ain't it funny how far FSWTC has come in 70 years!

So if FSU wins and goes independent will Clemson do same. SEC didn’t offer Clemson or FSU spot when they did Texas and OU. Little Ten isn’t offer Clemson or FSU spot with offers PAC 12 teams spots. I doubt UGA or USC would support Clemson in SEC.

None of the FSU suits will go anywhere...if they have given away trade secrets that have harmed ESPN they may get a free vacation in the Fed pen in Miami...as Mac has stated in lawyer terms and he knows what he is discussing the tests are...When did you know or when should you have known(a clock is run ing) when you found out why did you do nothing? During this time (2010, 2013, 2016) did you profit from doing nothing? How much did you earn if there was no GOR? If criminal action is found with FSU there could be a fine, penalty and interest! Slander and damage to the ACC and its members!

Who signed the GOR? How much did FSU gain by being a party to this contract? Are they going to give back to Clemson all of their share of our natty money? How come it took them so long to figure out it was a bad deal? are those injuns that stupid? What conference will want them? By suing the ACC they are also suing Clemson, we should never forget that small point! if by some quirk they should win then NcS, V Tech, Virginia, Wake and everyone else should sue them for breach of contract and monetary harm to their institutions! The health of the ACC is of no concern to savages!

If you want to know just how sorry FSU is go to any of the savage websites and read the hate and clouded perspective coming from their side! They don't just want out of the ACC...they want to destroy it...they were running their mouth for a year wanting more money than the other teams...then sued...ACC did file first because they saw it coming...they want to destroy the only conference that gave them a home...read for yourselves...hope they get kicked off the reservation and out of the teepee...I have come to dislike the horse eaters worse than those nugget wanabees!

Who would want t to play them...once you get there they will claim a GC outbreak and decide not to play... what is SOL? What is a contract? Who is responsible? When did you know or should have known? If you accept profit from a contract when do you sue? Where do Sunshine Laws apply? Once you have accepted a contract when can you break it w/o breaking the law? Exactly who is FSU suing? Which of these questions make you think.?..Judge!

Disclaimer - I am NOT an attorney but learned a lot watching Matlock on TV. 😂
First, I must say I am impressed with everyone here’s Pollyannaistic (I made that word up I think) outlook on the state of our judicial system! That fair and balance lady holding the balance…lol!
Seriously though, you are all arguing this based on what you think are the facts and legal precedent and fairness? What world do you guys live in anyway? Anyone who is awake realizes that politics and agendas of the elite will often heavily influence courts and determine ultimate outcomes. It does seem that FSU’s case is weak, but I argue that DOES NOT really matter. Why you ask? Because the powers of Fox, Disney, ESPN, and the media, etc. include broad representation of elite power brokers on BOTH sides of the elite and powerful political spectrum. It is my “conspiracy theory” belief that the FSU decision will be made by the big TV execs, not by some judge or court. All of these entities want FSU in the B1G-SEC 50 conglomerate of pro teams. FSU fits the mold perfectly. They have already conformed to the pro model of buying a new team annually. Sorry Brett, the truth hurts sometimes! The elite on both sides may argue about who gets them…ESPN or Fox…SEC or B1G. But they will agree the FSU brand is too strong to leave out. The judge(s) in this case(s) will fall in line with the elites wishes. FSU will walk from the ACC for a settlement of about $200-250 million.

Further “conspiracy theory” input on this…anyone else living in Pollyanna-land wonder why the second most dominant program of the college football playoff era keeps being cited as “not really desirable” in this push for the B1G-SEC 50 pro league? It makes no sense right?
Consider its coach is determined to buck the new pro system, is not buying into the pay-for- play model, still values building morals and preparing players for life after football, invokes the name and power of almighty God regularly - and on national TV, and stands up for a culture of good works and family. He thumbs his nose at entitled and pampered kids demanding to be paid ridiculous sums of money to go to college. He recruits those with high character who value the culture of love and family and education.
Face it, this coach and program is the antithesis of everything this new break-away of pro-college football stands for.
Again I ask, why would the second most dominant college football program in the entire playoff era not be a shoe-in for the new cutthroat pro-college money hungry league? 🤔

It is pretty clear that haven’t engaged with the substance of any real argument and that you do not grasp the dynamics at play. Your response is overly stupid. Suggesting that judicial outcomes are merely the result of political maneuvering and/or media influence is both cynical and inaccurate. Any legal system, while not immune to external pressures, is built on principles that do in fact resist your idiotic reductions. Moreover, conflating FSU's athletic program's philosophy with the legal merits achieves what? I'm no expert, but I think cases are decided on facts and the law, not your extemporaneous views, or an effort to have people click on this or that. Again, it’s clear you’re fishing for clickbait and that you haven’t read anything meaningful. If you had, you would recognize the depth the issues and/or evidence required to support your stupidity, both of which are far removed from the superficial meanderings you offer.

Correct...blogs, articles from 15 years ago that you ignored then, I think I saw Bigfoot once, and some crying about we made a bad deal and we could have made more money in the SEC except they did not want us...when you start claiming fraud you better have real evidence...a 4th tier farmout deal to Raycom from ESPN might be fraud in the athletic directors office but nowhere ekse...Looks like FSU painted themselves into a corner with this suit and then decided to go find some evidence!

I’m glad you believe politics are a non-factor in judicial decisions. Only the law! I hope for the sake of this country you are right. Our president disagrees…
https://m.youtube.com/watch?v=fkfn03I3y5E
“Women are not without electoral or political power”... to influence judicial decisions or court make-up? Is that not what the president means when he scolds the absolute highest court in the land? I argue neither are Disney, ESPN and Fox without electoral and political power! Yet you think my comments are completely absurd? Agree to disagree.

This case will go on for years and years and years. When it is settled there will only be a few years left on GOR anyway. Plus the streaming services are all ready in live sports. Streaming is the future. Apple TV and Amazon. ESPN might not even have enough money to buy the sec right by then. My point is we are in the acc for awhile. Best to focus on making the college football final 4. Because the truth is a lot of the super conference team are going to end up .500 teams. They have to play each other every week.
