Trump ignoring District Court universal injunctions - SCOTUS judge Kagan opines

Well well well. Even a liberal SCOTUS justice is doubting the legality of US District Courts in making universal injunctions (I.e., rulings that encompass more than the specific district over which the US District Court in question) against the Executive Branch which pertain to national impact.

Looks like Trump admin has grounds for not immediately complying with lower court rulings. SCOTUS liberal judge Elana Kagan opines; provides non-partisan context.

During the Biden Administration, Justice Kagan has previously criticized universal injunctions. In an interview at Northwestern University Law School, Kagan flagged the “forum shopping” by litigants in filing cases before favorable courts:

“You look at something like that and you think, that can’t be right. In the Trump years, people used to go to the Northern District of California, and in the Biden years, they go to Texas. It just can’t be right that one district judge can stop a nationwide policy in its tracks and leave it stopped for the years that it takes to go through the normal process.”

These are temporary injunctions that are only in place until the full case is heard

Federal laws should not be applicable in some regions and not others. They're either constitutional or not

That being said there has to be better ways to expedite these cases

SCOTUS judge Sonya Sotomayor does not even know what her job in the SCOTUS is supposed to be.

From ABC News report regarding her recent speech at the DC American Bar Associatiin meeting:

According to ABC News, the justice stated:

“Our job is to stand up for people who can’t do it themselves. And our job is to be the champion of lost causes… But right now, we can’t lose the battles we are facing. And we need trained and passionate and committed lawyers to fight this fight.”
