Prosecuted for what exactly?
I don't remember either guy mounting an insurrection, trying to steal an election, or leaving boxes full of nuclear secrets in the bathroom of their public resorts and refusing to return them even when subpoenaed by the FBI.
Also, keep in mind, if the judges decide a president cannot be prosecuted, there is absolutely nothing stopping him from executing his political opponents - including anybody who might impeach him - and then pardoning the guys who followed his orders. I know you desperately want Trump to have that power, but if Trump gets it...so does Biden.
Do you think a Joe Biden with no limits on his power wouldn't use it to summarily remove Trump and all his MAGA loyalists long before the election a year from now? Pro tip: guys with power always use what they have. Our Constitution works precisely because it doesn't trust him.

The latest presidential immunity question with respect to Trump’s J6 ‘election interference’ trial pertains to Trump’s private presidential e-mails, and the DoJ + FBI’s action to seize those messages without Trump’s consent. I don’t know how Twitter actually works, but there might be some sort of private Twitter files (again, I don’t know how this could work) that are private to the then-president Trump), but his X / Twitter account seems to be involved in this.
In any event, the alleged obviously illegal move by the DoJ / FBI is that they seized Trump’s presidential-era private messages without informing him. Supposedly the DC Appeals Court has a big problem with this.
Here is where it gets more fun.
President Biden allegedly possesses the power to either protect presidential immunity of Trump’s electronic messages or to reject presidential immunity for those messages.
The DoJ is allegedly terrified to push this ‘bring the presidential immunity’ matter to Biden.
Why so? Because (1) Biden would thus involve himself, as a political entity, in a purported non-political prosecution of his political rival in this year’s election -&- (2) Biden, by denying presidential privilege as pertains to Trump and Trump’s private messages, would also be setting precedent for DENYING HIMSELF of the same presidential immunity. (In case anyone has forgotten, Biden is facing possible impeachment for his involvement in the Biden family blackmail / bribery / extortion business).
The dung is about to hit the fan.

Of course, this DOJ won't let that happen. The Uni-Party has their Puppet for another year at least.
