When the place was first built. The rule then was something like no one could stay that was not a tenant more than 3 nights and if you knew someone was going to be staying there was a form you filled out and turned in prior to their arrival.
This was written in the lease agreement in a small section that nobody read. We found out about it after a letter was left on the door and we had to pay extra for the time I had already stayed without giving notice (and I was helping pay rent even though I was not living there as I was working and she was still in school).

or you'd have 12 students living in a 2 bedroom apartment. Very applicable rule in most cases, and the property management is wise to have such a stipulation.
But with a married couple - a military man on leave seeing his wife and child -- AT CHRISTMAS --- this rule is just not applicable and should be waived, or just looked past in this instance. With all the kind things people around the country are doing for military personnel these days, this just looks awful.
A free months rent would be the first step in making amends here. Landlord is NOT gonna win this PR battle.

I agree with the rules and I said on another thread, if I was responsible for paying water, electric, etc in my rental units, I'd probably have the same rules.
But, the guy in question is on leave from the military. He won't be there long. Just look the other way, landlord.

I also wonder if the landlord worries about discrimination suits. If he allows the soldier to stay rent free, someone WILL claim discrimination if he doesn't do the same for them.
Sucks but that is another thing to worry about when renting properties.

I have visited a friend that lived in similar apartments up in Asheville. I couldn't even park my car on the premises without a parking pass.

THE GROVES CLEMSON RESPONDS TO ACCUSATIONS
We are a military family and we welcome veterans and others who follow proper procedures to stay in our community which is federal law regulated. We are an exclusive student community that takes pride in the country we live in and our veterans who serve past, present and future. We are also a business that runs by rules, regulations and contracts. It is our responsibility to provide the safest environment possible to our students/tenants. Proper procedures were explained to both the tenant and the gentleman living there recently. The particular section that applies to this couple was set aside and initialed by the tenant as part of a signed contract. As it stands right now the tenant and her guest have refused to comply with a very simple procedure. Parents, guardians and grantors respect and appreciate our guest polices for the safety of their students who choose to live in our safe community. It is our goal to provide all of our tenants the same treatment no matter what gender, race, age, school or career they are or have chosen. Safety is our ultimate goal and we can not and will not jeopardize it.
We apologize that the media has misrepresented this entire situation based solely on the statements of only one individual and made it appear to be something it is not.

The letter on the website makes a good point. Without such a contract there would often be 10 students in a 2-3 br apt. That being said it would seem that exceptions could be made for certain circumstances.
There is one piece of information missing here. Is this a 1 bedroom apartment? Is she the only tenant? If she has roommates then should they have to take on an additional roommate bc her husband is on leave? If there bf isn't allowed to stay longer than 3 nights then why should the visiting husband.
If she is the only tenant in a 1 br apt than the property manager is an ### however I would guess that is not the case.

This was obviously not a case where 12 students were trying to game the system...
Also, It doesn't matter if it were one bedroom or not because married people only need one bedroom.
This is such a bad case of lack of common sense and plain decency that it is incredible.
This could have been a PR home run for this complex had they done the right thing rather than being jerk-wads at Christmas

tenants sign separate individual leases and share the common space, den etc. If that is the case and roommates are involved then the landlord is totally doing the right thing here. The other roommates would likely sue or use it as a precedent to do the same; other students in other apartments would then follow that lead; if my kid or I had been in that apartment and didn't know going in that that a roommate was having a baby, I'd be demanding out of the lease or contract enforcement because of that much less the husband moving in also. Totally in the landlord's corner if this is a shared space apt.

Would you like to extend permanent residency to anyone that anybody on a lease with the landlord would like to have come live with them? It's not a question of the spirit of the law, or the landlord's humanity. The guy has a right to know who is living in his apartments. When the apartment complex burns down, you don't want firefighters finding bodies of a bunch of people who weren't accounted for because they weren't actually known to be living on the property.

The most obvious question to me is why isn't the husband also on the lease? I've been married for almost 20 years and both are names are on EVERYTHING we own or lease. Seems to me this whole thing could have been prevented with a little common sense on the couples part as well. It's pretty common for leases to at least require the names of everyone over 18 living there. This would have been specifically asked for during the application/lease process. Its important if for no other reason than doing the proper background checks...i would sure want to know my daughter wasn't living next door to a sex offender...wouldnt you?Lastly, the guy being in the military is irrelevant...I appreciate his service but he should be held to the same rules as everyone else.

I'm not that familiar with the whole story, but it is likely that his name isn't on the lease because she moved after he deployed. He wouldn't be able to sign the lease from overseas, and if she is just going to be living there until his deployment is over, he would never need to be on the lease, as he won't be living there. The Groves deserves all of the bad PR they get for making such an issue over a husband staying with his wife and kid at their apartments while he is home for two weeks of R&R.

We found problems and loved to point them out. It became habitual to search for problems because we so enjoyed protesting them. I think that some of us evolved into the loathed groups know as PETA and the tree huggers' society, but I digress.
How about you starting a group to gather funds for this couple to live somewhere else until the young gentleman has to return to duty? A solution so close to hand could resolve this.

The excerpt of the lease sounds like the Sgt could stay for 7 days, then go stay in a hotel for one night, then stay for 7 more. Rinse & Repeat.
