specifically based on the "Alien Enemies Act". It does seem a rather convenient old law to use in this case. I do question though whether they have the authority, based on separation of powers, to say that the POTUS cannot declare an invasion. That assertion would of seem to lie within the jurisdiction of the Executive branch since POTUS is the Commander in Chief of the Armed Forces. The ability for POTUS to declare the invasion would allow POTUS to quickly muster a defense of the homeland.
What the Judicial branch should say is that POTUS is acting on an incorrect understanding of the Alien Enemies Act and cannot use such an understanding to simply deport thousands of individuals. There should be Due Process for such deportations in my opinion such as the case of Abrego Garcia. If he is guilty of something then deal with him within the confines of the law. If the law allows for him to then be deported then so be it. He will have had his day in court and a chance to represent himself. Just a thought.

In many cases I am sure that is a good thing, but as long as it is used on the right people and not just anyone here illegally or someone they mistake as illegal. That's how I view it. The problem is people go overboard and it's the going to bite the administration in the butt.

To be clear, I am not questioning whether Mr. Garcia should be here or not. The OP mentioned the article stating that the Federal judge was able to undermine POTUS by invalidating the Alien Enemies Act as a reason for his deportation. I am simply discussing what I think the article got right and wrong. I used Mr. Garcia as an example of allowing due process to determine what happens to him.

that illegal migration doesn't count as an invasion, and you can't deport citizens of an "enemy nation" if the US isn't invaded by an enemy nation.
It's not that the President doesn't have the ability to declare an invasion. It's just they can't call a gang an enemy nation.
