You have the Big 10 and SEC essentially getting together to monopolize a huge market. How is that not a lawsuit?

Maybe once they officially declare the playoff to only consist of B1G/SEC schools. That is where we are heading. They are making sure they make substantially more money than the other conferences. Eventually that will lead to a massive decline in the smaller conferences and therefore they won't be considered viable competition anymore.

a new league. The obvious problem with that is the money left on the table. ESPin and Fox, along with all the other networks would be bidding for TV rights to those excluded from the SEC and B1G.

That's not only money that the SEC and B1G could pursue it's not monopolizing playoff. Other conferences and teams can hold a playoff too.

Getting left behind is not something we should worry about unless it's getting left behind when Jesus returns.

Calculation to meet the Herfindahl-Hirschman index threshold that the DOJ uses to evaluate how concentrated a market is. You're basically saying that the two conferences working together constitutes a merger that would damage other firms in the market. It would be hard to make that math stick due to how many conferences and programs are competing in CFB.

The Owls can charge as much for a stadium seat as ND. The ACC can charge ESPiN or Fox as much as they want. Pricing is the key and the heart of the law.
