You're telling me I have to pay hundreds of dollars for you to take the photos.
Then I have to pay again to get the photos I want.

baby pictures and things of that nature. It takes real skill and you have to have an eye for capturing moments and frame composition. Even after hours of actual photography, there were countless more hours editing the 800 pictures she took.
I can't speak for all photographers, but the people who do it right are absolutely not scamming anyone.

I'm saying give me one price. That price should be for the shoot and then a set amount of pictures.
Why would I do a photo shoot and not buy the pictures.

friend of a friend who was in Architecture (not an architect, just worked in that field somehow). He bought a nice camera and then got laid off. He started a photography business and we were one of his first regular clients. I think his fee was $50-$75 for a session. As he got better he upgraded equipment, and started getting booked up. Prices went to $100 per session quickly. Then it was like $150 for a half session with a limited number of photos. Now he is doing real estate photography, weddings, engagements, etc. Dude is doing that full time and never went back into architecture or any regular job.
His website pricing is this now...
Wedding packages start at $2200.
Portrait sessions and engagement sessions $250
And he STAYS booked out.

A picture doesn't require a watermark to be copyrighted. A lot of times, it's a tell for additional metadata that in the pic. See my post below about all this.
IOW..if have someone take pics of your kids...they ALWAYS own that pic..watermark or not. Don't repost those pics, copy them etc..without permission for the photographer. I'm dead serious-You don't want to mess with this stuff.

If you REALLY want to know a picture scam...
Oct 12, 2022, 12:16 PM
|
|
There is a guy in Charleston that takes pictures of stuff around town. The pineapple fountain downtown, the Cooper River Bridge, Breach Inlet at dawn...stuff like that. Last year, he took about 6-9 pictures. He legally copyrights all the pics. He also made a little more than a million $ doing it. How you ask?
He puts them on the web, and pays search engines to make the pics come up at or near the top of the search list when you search for "Charleston Bridge" or "Charleston beach"...something generic like that.
Then, he has metadata embedded in the picture, and has a software package spider go out and search for the pic when it is reposted by someone else and it "phones home". Then he sues the person who used it for copyright infringement. Because the pic was copyrighted, he has damages basically already approved by the courts, and will settle out of court for an amount big enough that almost matches what an attorney will charge for defending someone in court that he knows will lose, because the person who used the picture without permission is already guilty.
Folks who do this are called "copyright trolls", and I'm not sure how they look themselves in the mirror. Basically they use the law to extort money from people who mostly unaware of the consequences. I doubt most people have any knowledge of the ramification of merely reposting a picture.

Depending on the photographer and teh agreement he signs, he may, or may not have the permission to repost this pics. So he posts them, the wife posts them, momma anem post them...and only Cooch had rights to do so.

That, I get, and understand the damages. This is a whole new level of inventing a crime where none existed. And you'd think in this day and time, if there was some level of damages, at least a take down notice would be required--it is not. It can go straight to legalized extortion and to "guess what? You owe me a bunch of money or I'll bury you in legal fees." It's BS to the highest degree, and no one will ever convince me otherwise.
But lets go back to Cooch's situation. Let's say, like I stated above, cooch's wife and MIL post the fam's pics--that Cooch paid for--online to let the rest of the Cooch clan see Cooch spawn. Think that's worth several hundred grand in "damages"?

Well, Coach can post them as he sees fit if he buys them. Where the problem arises is if his family starts taking them and using them publicly. When he purchases the photo, the photo license is exclusively for him.
A better analogy is if Coach hires a photographer to take pics for his new home improvement company, Things Fall Apart. He's given an open license by the photographer to use the photos, such as for his ads and all. But he can't give those photos to another party to use freely in the public domain.
Back to your example, it would also depend on the contractual agreement between Coach and the photo company.
Now, back to the other example you cite, it's a pretty dirty tactic, but a legal one none the less. It's definitely gaming the system.
Interestingly enough, the SCOTUS is going to hear a case on fair use and photography so things may change a bit soon.

Yeah, that's one profession with a shit-ton of imposters. Especially in the sports world.
It's like anything, you will likely know talent when you see it and it is worth paying top dollar for. Everything else is just pedestrian.
There was a great example from the World Series a couple years ago, Chicago Sun Times laid off their photogs and gave the assignment to reporters with a memo explaining how to use their iphones. The results were pretty staggering.

can't speak for all photographers

but i don't hold people's photos hostage. I'll charge a specific amount for a shoot and then give all the digital images I take to the client.
I usually under-promise and over deliver. For a mini-session I'll say $200-300 for a 20-45 min shoot for 5 images and then deliver whatever I take that turns out decent (usually more like 30+ and sometimes well over 100). I'd much rather make them happy and feel they got a great value then they'll spread the word and I'll get more business.
Some shoots, esp Real Estate shoots, are straight forward pricing as well.
Weddings are a different animal, because I'll usually deliver the RAW image files as well but I never liked people who charge once for the shoot AND then double down when it's time to deliver images. Used to happen a ton when ppl wanted prints. Not as much with those anymore but it used to be clients would get triple screwed. And yes, if you have a good phone and filters you can save a lot of money if you want to DIY but hopefully an actual pro can get better shots and afterwards you'll be less stressed and happier with the results.

nice Fall pics of the kids and family. She calls up several people and gets quotes. FBCoach being the misogynistic type of dude, he decides she is dumb and that since he is a teacher and has 1 billion hours of free time, he will harass a few photographers and bait them into a cheaper package that includes the sitting fee. No one will bargain with him, so he comes on TigerNet to complain.
