ND gets about $65 million in federal research grant money.
They can do as they please, but if they were to not admit women, homosexuals, or minorities they would probably lose that money. Why is religion different? With the pressure put on institutions such as Augusta National and VMI, it shows that it really doesn't matter what your "tradition" is. In fact, your tradition is usually what drives leftist activists crazy and so they try to destroy it. Nothing should come in the way of your worship of the all-powerful State.

based on religion, that would be one thing. But by being a religious supported institution, if you choose to go there, you should have a reasonable expectation that religion will be part of the environment.

there were ~64 all female colleges, many private & all of which earned fed money.
even the offer to build a "mirrored", military program at mary baldwin was considered, no bueno.
i'm sorry, but i'll likely forever believe it's about whether they "can" with absolutely no consideration for whether they "should".
some people just want to watch the world burn...

so they wouldn't concern themselves with ND. Please don't tell me your ignorant enough not to know ND is a private school. FFRF is absurd, but if you're going to speak on this issue at least have some knowledge of the difference between private schools and public schools.
