This is the view we had Friday night while turning left. The closest lane is blocked from view until the last 15-20 feet or so. No, if vehicle 2 is also speeding, what freaking chance do you have if they just happen to be in that blind spot?

For putting the poles there? Maybe, if it's been an issue before.

As for the other driving speeding, if they were actually speeding and at fault, and the police report says so, talk to a plaintiffs attorney there.

I've done plenty of car wreck cases from the defense side (defending drivers at fault). If you're not at fault, and if you have evidence the other party is at fault (dashcam, police report, witness statements) then you've got a good chance to get money from the driver's insurance, assuming they were insured. Most drivers have the minimum required liability insurance. In New Mexico the minimums were 25k/50k, meaning 25k per person, 50k max per accident from insurance. The money is usually from the insurance company, going after the individual is much harder and costly.

Hiring an attorney will probably get you more money. Litigation is a ############ with depositions and wait times and such...no fun. Lots of plaintiffs attorneys will send you to a "doctor" for like 12 visits to get your medical bills higher, and increase your settlement value. I hate that game, but there's money to be made in it for the injured party, especially if they aren't the tortfeasor.

Not legal advice, just anecdotal information from my experience regarding the car accident litigation scheme. Talk to an attorney there, they know the law and the games. Billboard attorneys are usually good enough at getting you some money. If you or your wife were seriously injured, do some research on practices that don't take volume cases. Nonvolume firms usually pay more attention to your case. Talk to multiple attorneys, you'll work with them a lot and want a good relationship. You're the client. Shop around.

This is a case where a pole broke (probably from a wreck in the past) and they put a new one up in front of it. That made a huge difference in the amount of view you have when looking left to turn.

It's not until after the entity responsible has notice of how bad the problem is that liability becomes possible. Raise hell about it by talking to people at the county or city and if someone says something like "oh yeah we have chaos at that stop," then write down their information. I'd be pumped if my client had someone to depose on that issue.

Theoretically, the municipality gave them a blank order to be able to put poles in the right of way

Should also notify the city they could be liable for even allowing a pole there

What's the view look like from where you'd be when turning? That view is from the edge of the street. Unless you're in a cab-over truck, you'd be about 5' further back (left in the photo) and should have a better view of the street.
