Whatever Law Firm drew up the GOR did a great job....

Aug 5, 2023, 10:01 PM

Face it by now almost all ACC schools have had their team of lawyers look at it and it still stands. So why not hire someone from the original firm who wrote the GOR to advise us (and others) how to break our contract and not go broke doing so.

The Private Equity Firm buyout route sounds too expensive for little old Clemson.

What do these universities do with all that endowment money these days?

Probably the same lawyers that got UNC off the hook.

Endowments are very restrictive on what the funds can be used for. Also, they can’t be used for athletics unless specifically earmarked for that purpose.

Curious of everyones thoughts on whether the BOT and DRAD should be looked upon as dropping the ball on locking Clemson into this mess.. I of course, have almost no information on whether it was indeed the best deal out there at the time. Although I do question Clemson Athletics locking us into such a long term deal without any reasonable loopholes , such as if the landscape changed throughout the college football world. I haven’t seen many call out whose really responsible for us being locked into this, which is DRAD , NEFF, and the BOT. I doubt NEFF wasn’t in the discussions and should that shed any doubt on NEFF making the correct next move .

At the time it was signed, we were trying to keep the league together so how is it dropping the ball? The thing has worked perfectly so far

I believe it was a complete lack of foresight on most

of the member schools' administrations that resulted in the GOR.

That's because I have believed for many years that there would be large upheavals in conference alignments, something the Clemson admin should have anticipated followed with determined opposition to the bugaboo called the GOR.

I am no lawyer, but if a rule in place deems to be adversely affecting a number of people, then that rule should be challengeable. The GOR (IMO) stands to affect extremely negatively what should be member schools' rights to protect their programs from predatory steps taken by other associations, which is precisely what I believe is occurring with the B1G and SEC.

Hence, what I would like to see is a major lawsuit against the ACC and GOR, despite any initial support by Clemson, now accusing the league of having in place a rule negatively impacting its members. Secondly, that the rule adversely impacts its members' abilities to remain competitive in today's market.

More than likely, if the ACC is not proactive, Congress will eventually involve itself in attempts to level the playing field. There's just too much money involved with a whole lot of prominent schools facing the real probability of being on the outside looking in. Thus, if we refuse to go the legal route, then we should strongly pursue the legislative one.

Mornin', Harry.

Glad we're both still kickin'.

I don't want government involved in football. The probability that the government will 'fix,' anything is slight. The probability that government fixes will end up like the EPA or any other government oversight is vast.

I hate to disagree with you but I do so with ultimate respect and no intent to dishonor an honorably man.

The GOR is a legal and binding contract. All parties agreed to maintain a union for a specific period of time. I am certain the GOR could be broken and Clemson can escape but there are contractual penalties for any school wanting out.

Imo, FSU's whining about needing a raise is due to either greed or overspending. Neither is justifiable. I'm glad Clemson has remained silent and I believe Clemson would take healthy bonuses for bowl and Playoff earnings.

I don't think that fixes the problem but it will pacify until the GOR penalties diminish to a practical buyout level.

If our hope is in Congress the most disfunctional and polarizing group in the nation just plan to be in the ACC until 2036.

Conflict of interest?

When a lawyer works for someone they usually don't work against them later. I suspect it has something to do with knowing things about a client that are 'privileged,' private between that lawyer and his client.

They would have no problem challenging the GOR minus Time

Aug 6, 2023, 6:02 AM

They can force the GOR to end but these days the angle would that the players are being held down and can’t make the money they would via NIL & advertising because the schools are not competitive on an equal basis over period of 20 years when everything has changed about the sport because of the NIL and the contract didn’t take into account congress would create these changes.

It’s a different sport now, the teams wouldn’t have signed it if they knew these changes would affect their players and their rights to market themselves and be competitive through the NIL with the rest of the leagues. The contract was to make them stronger together not hurt their ability to compete with the rest of college football.

If the kids protest the ACC hand would be forced in my opinion but I’m not saying this is the right thing to do.

The teams also might be waiting on Disney who’s losing money to sell or collapse their ESPN holdings or claim the ACC network has never had the investment they promised as part of this overall picture.

Lawyers will attack from all areas to find the weak link.
