Innocent until proven guilty
Nov 21, 2013, 9:45 AM

I've seen a ton of threads today and yesterday already condemning Winston for an accusation that at this point is a "he said, she said" ordeal. All that's been proven so far is that they had a sexual encounter, that's it.
We are too quick to judge someone, especially athletes or celebs, whenever there seems to be some dirty laundry or reported crime happen because we want them to be dragged back down to earth or it just fascinates us.
We have the Bill of Rights for this very reason, the defendant is innocent until proven guilty and the burden of proving it is on the accuser/prosecution.
Maybe it wasn't consensual, I have no idea, but let's hold off on assuming that the version of the story that Winston's accuser is telling is the absolute truth, and let the police investigate it fully before we demand his head on a silver platter. Have you not heard of girls partying/drinking too much and doing something that they later regretted then lie and try to say they were taken advantage of?
Irregardless of the outcome of the case, this should be a lesson to all athletes to make wise choices because everything they do is in the spotlight and often times people want to see them fail. This is something I think Dabo does a good job with instilling into our players.

Why do people think that the Bill of Rights applies
Nov 21, 2013, 10:17 AM

everywhere? He is innocent until proven guilty IN A COURT OF LAW, not in public places of opinion, whether it be a talk radio, a sports message board or TV program.
There is no law that says we cannot express an opinion.
OJ was found to be innocent. Guess what. He's not. He's a murderer! I can't put him behind bars, but I can still state what I believe to be the truth.

but my point was oftentimes we jump to conclusions, especially when they're famous. Water cooler talk and opinions are always gonna happen, I just try to use caution even if I want to believe something is true

I'm sure Winston didn't go to the police and say "hey can you take care of this for me?". Yes the officer in question is at fault for even speaking out to the victim in this manner but that does not mean Winston is innocent or guilty.

I agree with your assessment however you have to ask yourself why Winston has not provided the police this information earlier to acknowledge the fact that he was with her that night. He was very much aware of what he was being accused of yet it appears that there is no record of him coming forward to tell his side of things to set the record straight. Instead it appears that there was only denials by him and his roommate that this incident even happened yet the DNA tells a different account of what happened. As we all know the truth is usually somewhere in the middle and the young girl has the right to not be labeled as a liar just as much as Winston has a right to his day in court. You are also correct in that athletes need to make very wise choices in every aspect of their lives.

I thought it said he cooperated with police then they told him in Feb that that case was being dropped, also it said that his lawyer provided police with two affidavits(sp)* of people that were with him that night, doesn't mean they couldn't lie of course, but it's better for him than no witnesses.
Hold on let me find that link

what i would rather have occur.
1) Winston gets suspended in the next couple of weeks. Perhaps FSU still beats Florida and Duke(if they win out) without him, but gets rolled in the title game or maybe even voted out of the title game by the polls and their dream season comes crashing down around their fans.
2) This things gets dragged out, Winston plays in the title game and FSU beats the snot out of Bama. Winston then gets charged and kicked off the team so that we can beat FSU in Tally next year and reclaim the ACC.

but if this accusation is true and if it's proven to be true, it could destroy his life and career.
This is bigger than stealing a couple of computers at Florida then doing the junior college thing for a year before going to Auburn

media hasn't helped him with any of this. That makes him a target of those who want to bring him down. Plus FSU has a bad but deserved reputation in some cases of appearing to cover up bad things their players do.

Should he go to jail based on these accusations? Of course not. Should he continue to play football this year? That's another question.
