They can't go to jail. Can a federal court really order them to pay? Can a federal court even hear the case? I'd say we'll pay you the original exit fee from two years ago. Take it or leave it.

And yes, whatever court has jurisdiction could enforce payment. And should the school decline to follow a legal order then whatever representatives of the school responsible for following the order (be it the president of the school, the board, the financial officers) could be held in contempt.
It won't come to that. But simply refusing to pay is also not a legal option for them.

would a judge actually rule that a state school/entity have to pay some outrageous, punitive fee to an organization that for all intents and purposes only exists as a result of the very member institutions it exists for? Me thinks not. Also, what is in the contract between the schools and the ACC? Did UMd sign a contract 10, 20, 30 years ago that even mentioned exit fees? If there are exit fees in that contract, was there also a stipulation that this exit fee could be increased w/o UMd's express agreement to that increase? Most people dealing with contracts tend to shy away from such open ended stipulations.

I bet they don't pay over the 20 plus court cost. They voted no then left b/c of it they will plea I would think.

The Big 12 is wasting an awful lot of money paying MD to join it. Their program isn't worth what they are paying us to leave, much less anything beyond that. This is a win-win situation for us. We get $52 mil in cash and get rid of MD. Kinda like finding a winning lottery ticket on the street corner.
