Hello, I am the photographer who captured the CLEMSON sparker photo that seems to make its rounds every couple of months. My wife has PMS but never EMS? Please explain your photograph. Is there a deeper meaning? I should warn you… some of the guys in this forum drink a little. While I don’t normally partake… I may have had a drinkiepoo or two, today. Just to keep the cold off of me.

they put up high res photos on their website precisely so they may be easily copied.
Copyright trolls then use a program that crawls the internet looking for the copies and they sue the person/entity who is using the photo. They specifically target companies who might use the copyrighted image on their website.
Copyright infringement is a strict liability tort. The key is the troll needs to register the copyright first so that statutory damages are available. Under the copyright act, statutory damages can be up to $150,000 per copyrighted work. Also, attorneys fees for the prevailing party are nearly automatic (unlike most federal and state law).
