Implied consent:
South Carolina law states that any person driving in this state is considered to have given consent for testing of breath, blood or urine for the purpose of determining the presence of alcohol and/or drugs in the person’s system, if alleged to have committed a violation. If you refuse to submit to BAC testing, you face an automatic 90-day suspension (180 days if there is a prior alcohol-related conviction or suspension within the preceding ten years) of your driving privileges if you are 21 or older.

Correct. You cannot be guilty just by refusing the test (in either North or South Carolina). You still get your day in court. But, refusal does mean immediate suspension of your license.

But you can get a Temporary Alcohol License that allows you to drive for work, Dr appts, attny mtgs and to get groceries as needed. Then if found guilty then you can lose your license for 6mos to a yr. If he didn't test and has attny, most likely his case will be settled out of court and he will plea to a lesser crime like 'Reckless Driving' which has a big fine and jacks your insurance through the roof for 3yrs. It will be a $15k+ mistake basically.

I am wondering if the Corvette was part of a basketball NIL type lease and had to be returned. In Clemson, I don’t feel it would be too difficult to find out where he was drinking. If it was at a downtown bar, they probably have cameras. Ian knew better than to drive the car. He should have gotten an Uber or called a friend. Heck, he could have called a coach. Anything was better than driving and putting others at risk. Has anyone ever noticed that the drunk driver usually survives fatal car crashes that they caused?

We don't have roadside "breathalyzers" in SC. We have the datamaster at the jail. Field sobriety tests are given roadside. If refused, you're arrested. Once at the jail, you're given the chance to give a breath sample on the datamaster. If that's refused, then there's an automatic 6 month DL suspension.

Refusing a breathalyzer is automatic 90 day suspension, not 6 months. Unless you have previous alcohol related charges within the past 10 years.

There is no breathalyzer in SC, we use what's called the datamaster (DMT), which is inside of the jail. And it's an automatic 6 month suspension for refusing to give a breath sample on the datamaster.
Google it if you need to.

Why do these kids blow such great opportunities 🤬🤬🤬 it frustrates many fans.

In the next 5 to 10 years I believe addiction to betting, substance abuse, anxiety/panic attacks and mental health issues are going to plague what use to be college football.

How could this guy stick to Dabo after the opportunity Dabo gave him. How many years of eligibility left.

One way to stop these kids from getting into trouble is to hit them where it hurts most !!!

Field sobriety tests are subjective and useful only for prosecution. I would never submit to one, it’s too easy to say someone “failed”.

I did some stupid stuff as a student so I'm not gonna lambast the dude, but I dont get high profile people and DUIs these days. There were no rideshare services when I was a student. Plus I'm guessing he's had a pretty nice NIL package these last couple of years so he should be able to afford a $10 uber.

Another disappointing thing; aren't they supposed to be in camp? Dabo always says Sleep to win, eat to win, train to win. Being drunk at 2am during camp violates two of those 3 axioms.

If the reason for the stop is the crossing over of a center line , that's pretty flimsy. Particularly if the officer observed this in his rear view mirror at night. Had he have gotten him with the radar gun for speeding to initiate the stop , that would be solid grounds for the stop.
I'd say a good trial lawyer gets that DUI charge diminished or removed completely.

If the cop is doing 40, and the speed limit is 40, and a car charges up from behind while crossing the center line, that's plenty observation to initiate a stop.

That maybe true but is that what is needed or correct.
The man was driving home at 2 AM on a Saturday night Sunday morning driving apparently to fast and you and me and everyone else knows He had been drinking if not drunk!
That’s a serious offense and He should pay for it!
Not for the rest of His life and maybe not even the entire season but He should miss games and have to deal with the law just like the rest of us!
If not then chances are no lesson will be learned !

the probable cause / initial stop is brought all into question. Has nothing to do with football side - still suspend there. And if you were overserved, be thankful this didn’t end differently and take an uber next time.

The "crossing the yellow line" is typically put in to the report to cover probable cause. It's almost bulletproof when a cop says you crossed the line, whether true or not.

how much he crossed the center line, but it was clearly enough for the officer to think something is up and make a stop...and guess what...he was 100% correct. Sounds like the officer did his job.

He might have been, but they make unlawful stops all the time around 2 am, with one excuse or another to cover probable cause. Several people I've known have been stopped like that in Clemson (didn't come to complete stop, swerving/driving erratically, crossed the line, etc., true or not). They weren't drunk, hadn't been drinking, and did the right thing by apologizing for whatever thing it was they didn't actually do. Never challenge an unlawful stop on the spot.

Agreed and also nothing was mentioned as to why he was arrest for dui. No mention of blood shot eyes slurred speech. So good lawyer can get dismissed for no PC

in Clemson could see this coming. I’ve seen & been passed by the green & the purple vets numerous times at different times during the day & night over the last three years. I’ve witnessed weaving in & out of lanes and hard acceleration by Chef plenty of times. And lord knows I did the same thing at his age. I like IS. He’s been great for CU and CU has been great for him. In this instance, he just screwed up. There is absolutely no reason for him to get behind the wheel if he’s been drinking. He can afford an Uber. I know of many CU athletes that Uber all the time. He made a bad decision. It just sucks for him because now the football deal is ruined and it sucks for Clemson because of the bad publicity. In reality, it’s not a big deal overall for either entity. Move on. The folks blaming this sitch on the cop or the construction in Clemson are part of the problem with society today.

Shame that since he made it home that this officer did not give him a heavy handed warning but instead chose the harsh reality of a DUI arrest. Shef can hire a good attorney and this likely will be reduced to a wreckless op plea which is a step down from the DUI. Obvious this a no nonsense officer.

Crazy to drive under the influence anywhere but to do it around Clemson is beyond idiotic. It has to be one of the number one spots in the state for traffic violations issued per capital. I was around Clemson for a month recently and every road in and around town you constantly see people getting pulled and ticketed. If you regularly drink and drive it is just a matter of time. A short time.

Based upon what I'm reading, the police report is weak and holds no real weight. Time for a complaint in civil court and hopefully, he wins millions of dollars.

Everyday, across this nation police officers are lying to put innocent people in prison. NEVER TRUST A COP AT HIS WORD! I hope this strikes a nerve at the core of every police officer on here. Why? It's because I lost my house, Jeep, truck, two Harleys, my furniture, my business, and my peace of mind because an officer lied in his police report to secure a warrant for my arrest. Whenever I was sitting in jail, I learned that many people could have been innocent and they were waiting for 2.5 to 3 years in Spartanburg County to receive their day in court in order to clear their name. Until this is rectified, I will always give middle fingers to Police in the name of the U.S. Constitution. Same goes for judges and state attorneys, especially crooked clerks who work in the court. In the end, I was found rightfully not guilty because I refused several plea bargains. NEVER let a state attorney scare you into accepting a guilty plea if you're innocent. Do NOT be afraid if you are innocent because a jury will see right through it.

I am sorry for your experience at the hands of unscrupulous policing tactics. I also appreciate your passion for upholding our constitution.
