“This is a devastating loss for the family. We are pursuing those who could have stopped the death of Da’Von,” said the Capers’ attorney, TODD ELLIS, who filed suit with co-counsel Jerry Reardon.
The Caperses allege that the Cook Out eatery “knew or should have known” that numerous students from Dutch Fork High School and Lexington High, longtime rivals, would be arriving there after the game and that “tensions between the students would be high,” according to the lawsuit filed in Lexington County.
USC should be careful about allowing Ellis on their property. They could be held accountable if something doesn't go his way. There are lots of possibilities.

This where our legislators need to take action and protect businesses and people from frivolous lawsuits. If they lose they pay court cost and lawyers fees.

Todd Ellis is one of those lawyers who will sue anybody. And it's lawsuits like this that have put people out of business and restricts our rights because people are afraid of an incident like this.
Really sorry the kid is dead. But these days you better know what your do when you get in a fight???
What about the HS kids responsibility of the kids from both high schools and what about tne parents responsibility!
