LInk for the 13 year grant of rights...

May 27, 2012, 9:27 AM

Officially, they are at 6 years now. They have verbally agreed to a new deal with ESPN/Fox. Although not signed, it also includes an extension of the grant of rights.

One good reason they haven't signed yet...

waiting to add a few teams

So, once we enter the Big 12, we will be locked in for 13 years (after they add the teams) to the Big 12, not able to leave without severe financial penalties (in effect keeping us in for 13 years). Am I correct?

May 27, 2012, 9:46 AM

blood pact and would galvanize the big12. they had one in place and 4 teams left. the acc has one[that's what these contracts are york] and it's possible teams will be leaving.

no one gives up the rights to their 'brand'/likeness/use of trademark/copyright exclusively. if in fact an entity misuses it or goes outside what is specifically granted, they can be sued.

I agree.... schools can leave when they want....

The B12 signed the GOR after the four teams left. Prior to that we just had a conference exit fee (same as the ACC has now). ACC has no GOR in place.

A Grant of Rights is when each school in the conference signs their TV rights over to the conference. This isn't a "blood pact" by any means... any team can leave at any time. It's just that the B12 owns their TV rights for the duration of the contract. So if Texas moved to the SEC for example. The SEC would get NO TV MONEY for the Texas games. That money would still go to the B12. What it does, is effectively render teams under a GOR worthless to a different conference, and thus not worth taking.

The current B12 GOR is 6 years. It is expected a 13 year GOR will be signed with the new TV contract. This hasn't been signed yet.

flag link military_tech thumb_downthumb_up

Grant of rights is a definition of the a contract clause...

May 27, 2012, 10:50 AM

by which one entity takes legal authority or power of attorney over another entity in a very limited capacity. In this case it gives the power of a conference to negotiate and execute a TV contract for each school within that conference.

Basically, it's what we gave the ACC and will cost us 20 million to get back.

It's a typical school/conference agreement and is most likely not exceptional to the Big 12 in any extraordinary way.

clemson.

and yes, the exit fee i'm sure is designed to cover the loss of media money should a member school leave.

tejas has given up nothing and would only be 'penalized' that agreed upon exit fee which is not part of this contract.

Correct. The B12 shares all 1st and 2nd tier TV money equally.

We just moved to this (after the 4 teams left). Up until last year, teams were paid based on TV appearances.

flag link military_tech thumb_downthumb_up

I understand the problem with having an 'appearance clause,'

May 27, 2012, 3:27 PM

in a contract with a state the size of Texas. Since I was born and raised in TN you must excuse me for not referring to them as UT.

The Texas viewer-ship draw is about the number of fans and not the importance of the team on a national scale. I knew revenue sharing had changed and also knew the old contract was what caused the defections from the conference. I didn't know it was such a radical change. I guess Texas feels somewhat slighted now.

Are you talking about Texas' present contract?

May 27, 2012, 3:31 PM [ in reply to the acc has very limited, specific rights to anything ]

I am certain that were someone to defect from the conference nothing could stop them since civil courts only give and take money in lieu of contract violations.

What specifically about the conference agreement speak ye of?

Don't start that secks chit today. I'm still sore from last night. ;)

May 27, 2012, 11:13 AM

I don't think that's correct. The Big 12 didn't have a grant of rights when the 4 left. The ACC also doesn't have a grant of rights now.

flag link military_tech thumb_downthumb_up

the grant of rights it to the acc/big12ish/sec tv rights.

May 27, 2012, 11:41 AM

yes they did, yes they do and yes they will.

it is what this arrangement is called.

Re: LInk for the 13 year grant of rights...

May 27, 2012, 1:42 PM

Discussing/arguing the specifics of these conference contracts is interesting, but can all of you please state that you really don't know the specifics of any of these contracts? I mean TDP said this is not public info and is a private contract not subject to FOI requests and even he doesn't know the specifics of other conferences contracts.

This is why I find some of York's post a bit over the top because he sometimes says things like he has the Gig 12 TV contract in front of him.
