Question for lawyers in here

1

Apr 28, 2023, 3:36 PM

I had a commercial truck repaired outside of Atlanta a few weeks ago. They installed new injectors among other things and the invoice was $11,000 which I paid with my business credit card. After repairs were made my driver picked the truck up but it broke down about 5 miles away from the repair shop. Since the shop had already closed for the weekend we called a third party mechanic to look at it. He came to the truck and after a few hours he said there was nothing he could do. His bill was $800 since it was after hours and he had to travel an hour each way to the truck. So we hired a tow truck to tow it back to the same repair shop, tow bill was $1,200. The repair shop looked at it on the following Monday and it through their admission one of the injectors they installed was bad. They replaced the bad injector at no additional charge to me. Bottom line I had over $3,000 of expenses I paid because the repair shop installed a bad injector. The repair shop has no interest to reimburse me for my expenses and the credit card company says nothing they can do.
How would I do in small claims court? Since I live in Charleston I would have to take off a day from work to attend court.

Since you didn't give them a chance to make it good, I don't see how you can make the claim in court for the full amount. Moreover, since you picked the truck up at the close of business, hard to make a valid case that you needed it for work purposes that evening.

Best you could do IMO is hit them up for the tow, but that's about it.

but the first question that is going to be asked is did you sign a work order that detailed the work to be performed and did that work order or contract include any type of express or implied warranty.

Also depends if the parts are factory or aftermarket---factory parts have a longer warranty. Also, unless there was a specific warranty delivered with the invoice for the repairs, I think he's out of luck.

Attached is their warranty.
The third party mechanic only connected to the data port to see what was the error code.

I would just do a charge back with the credit card company.
