That would be crazy if it was a hoax.

I don't really know how you could call it a hoax

I mean someone put the bananas up there.
Apparently the person(s) responsible fessed up for the stupid thing. I guess it was dealt with internally. I'm not sure if any criminal charges would apply... I suppose littering? Maybe some kind of vandalism charge, but it would be hard to make that stick.

If that is the case then it could be why the university is

reluctant to make it public. If it blows up any bigger I suppose they could reveal the person.
Kind of like the girl that created fake tweets and then tried to drum up a protest about it. The school ultimately revealed it was her when the story caught legs in the national media.

Yeah it's something the college is going to have to release.

The protesters know who put the bananas up there.

the university can't just going around naming people

involved in possible disciplinary hearings(which apparently this didn't even reach that stage). That info is considered part of a student's record and there are privacy laws that prevent that from being disclosed. Without charges(which are public), the most anyone can get are emails and memos describing what happened with names redacted. It's hilarious for people to scream FOIA without understanding that there are other laws that prevent certain info from being disclosed.

Hanging a banana on a sign isn't part of a students educational record that would be covered under FERPA.

protected as part of the student's educational records and the university "may" disclose info only on certain types of incidents which I don't believe this falls under. The university is going to fight and protect any student under FERPA in this type of situation to not get a privacy suit thrown at them. It's a legitimate argument, and one I don't think FOI should or will trump. IMO, ultimately a court would have to pick their poison if anyone desires to push it.

I would imagine your campus security cameras are controlled by campus police?
If so that is automatically an exclusion from FERPA.

I agree, releasing these kids names is the wrong move...their safety would definitely be at risk. They would have been better off not doing it to begin with.

I don't think the names necessarily need to be released but I can understand why the race is pertinent to the public.
