This is the exact reason why, if someone or some entity does not get control of this nil it will be the end of college football. The colleges will become minor league teams financed by the NFL to produce players for them. This is sickening if true, and Fla ought to receive the death penalty from the NCAA.

NIL contracts are perfectly legal and they are here to stay.
The problem in this case wasn't NIL. It was the collective promising money they didn't have.
That's not a problem with NIL. It is potentially old, garden variety fraud, as the court case alleges.
If there was no written contract, proof may not happen. If there was a written contract, it's lots worse for the collective.

The NFL doesn't have anything to do with NIL.
There is no "need" to get control of NIL. When you say that, it's like someone else telling you that they need to "get control" of your business.

The SEC,big 10? for sure! They were cheating before hand and now it is legal with no boundaries. It will be the end for football / all sports to a lot of schools that just do not have the $ support! It will ruin it for most student athletes that just want $ to go to school. 85 students x 40 teams = 3500.

They have also ruled that the NCAA can't interfere in it whatsoever.
The SCOTUS concurring opinion in NCAA vs Alston says that the NCAA's entire sports model violates federal law.
The UF case is an outlier. It's a simple case of someone promising to pay money they didn't have.
That happens all the time in the business world, but no one is saying "that's the end of business" when that happens.

You're conveniently forgetting to mention the decades of bagmen, new homs for mama, sports cars, no show jobs for daddy, etc that were rampant before the NCAA lost their azzes in the Alston case.
Now let's apply that to your job. It's about time that some 3rd party gets appointed to make times for your job, limit how much you can make, and interfere with any business deal you have with anyone else.

That's what NIL collectives are.
One case of fraud isn't an indictment of a system that otherwise is finally getting some fairness for the athletes, and ending the decades of the NCAA illegally exploiting them.

In the Tennessee and Virginia vs NCAA case pre evrs those lawbreaking NCAA rules from being enforced. The NCAA can't interfere in NIL in any way, or hand out any punishments for anyone that violated those illegal rules.

If they were minor league franchises, wouldn't the players be making less than $1mil? I read where the lowest paid NFL players recieve a min. $795K. There should be a cap on what these kids can make.

Oddly, Florida isn't named in the suit. I suspect you'll see college kids turning to agents in order to keep from getting reneged on after walking away from guaranteed NIL money. I'm in favor of either banning collectives or putting a wall between collectives and schools. It was unmanageable to keep boosters away from students but monitoring 150ish school's contact with boosters or collectives should be more feasible.

All bent over for the NCAA.
UNC told them to pound sand and got away with it.
Tennessee took the offensive and sued the NCAA, getting an injunction that ire evts the NCAA from interfering in NIL in any way.
If they win the case (likely) it's going to probably moot any NCAA penalty for boosters, outside benefits, or any previous penalties within the statute if limitations.
Reggie Bush already got t his Heisman back and us suing the NCAA for defamation. Given that what they said about him was based on their rules that were illegal in the first place, he has a string case.
The NCAA is in the run on every front. They are losing every court case and injunction.
It is silly to want to go back to their illegal eats in the name of "control" or "so I don't need a program to know the players".

The athletes are accountable to their NIL sponsors.
The athletes are responsible to maintain their eligibility through a minimum GPA.
The athletes have to attend practices, team meetings, and other required team activities.
The NIL collectives are accountable to their donors and corporate sponsors.
The people who purchase Phil Mafah jerseys are accountable for the check not bouncing.
Florida and their NIL group are accountable for welshing in a NIL deal when they promised money they didn't have.
The NCAA is being held accountable for their decades of illegally restricting trade, being an illegal monopoly, and exploiting the athletes' labor for money.
There is plenty of accountability.

Corruption and lack of control is the problem. Napier, the NIL Director, and the Booster (Gator Guard Collective owner) all knowingly violated NCAA recruiting rules during this fiasco and no one is there to hold them accountable.

involved. How can a coach or school not be involved in distribution/decision making to athletes even though theyre not supposed to...? Do the donors just pick the players they want to pay?
And the rule of how paying players cannot be an inducement for recruitment. THIS is LAUGHABLE.
I frankly don't really care - as long as the players suit up and play, I'm good with however they get on to the field.
But I am hoping more suits like this will push some governing body (certainly not the NCAA as they are without purpose or teeth) to intervene and actually creating some type of regulation. Right now, it's a bit of a mess.

The NCAA rule against it is mooted by the injunction in the States of Tennessee and Virginia vs NCAA case.
That case started when the NCAA went after the University of Tennessee and their QB, Nico Iamaleava, for exactly the situation you cited. The Tennessee state AG filed the case as soon as the NCAA fined their notice of investigation. The Virginia AG joined the case a short time later.
They won an injunction that prevents the NCAA from interfering in NIL in any way.
That case has a way to go before trial, but in the injunction, the judge said that the plaintiffs are likely to win on the merits of the case. It's based on the 1890 Sherman Antitrust Act, similar to the NCAA vs Akron ruling.

It's not nonsense. It's not going to end.
So say the federal courts in the Tennessee vs NCAA, Ohio vs NCAA, NCAA vs Alston, O'Bannon vs NCAA. Those cumulatively say that the portal, unlimited transfers, and NIL are here to stay. The NCAA is enjoined from interfering with them or limiting them in any way.
Add the billions of damages that are under consideration in the House vs NCAA and Carter vs NCAA cases, the NCAA will be lucky to survive.

There is zero semblance of amateurism anymore. When word gets around of how much moolah is flowing at other schools, how can we attract even the average player to come to "lil ole Clemson" just for the family atmosphere and a good education?
