Why would the civil case go on and depose DW before the criminal case is considered for indictment. Unless the plaintiffs want him on file pleading the 5th thinking it makes him look guilty OR Devils advocate, DWs lawyer pushed for it knowing it would be basically a worthless deposition. Seems like a waste of time and resources.

Former prosecutor here. Without knowing all the facts this does not seem like a good development for Watson. A prosecutor will rarely present a case to a Grand Jury if they do not think it will result in an indictment. Cases presented to GJ are almost always rubbered stamped. The standard to issue and indictment is only a finding of probable cause (low standard) not reasonable doubt like for a conviction.
Even if he is never convicted, just having pending criminal charges will further delay any possible return to football unless the plaintiffs agree to some type of civil settlement that includes dismissal of criminal charges. But with an elected DA they may not agree to that and so they don not look like they are weak on an assault type case, special treatment for an athlete.

Also, DW has not helped himself with his potential jury pool. I mean he wanted out of Houston and it is not like he is the local beloved QB, etc. Yes, may seem trivial but those things matter. Jury pools are human.

Agreed on the low threshold to meet for indictment. We've all heard the phrase "You can indict a ham sandwich."

What's odd to me is the time this has taken to work through police investigation and the grand jury. A year for 30-40 interviews?

You would think Watson's attorney would be trying to accelerate this. The faster this situation gets resolved the faster DW4 can play again.

Zero evidence or overwhelming. It was high profile and possible sexual misconduct. In this day and age, no DA is going to make the call to not at least send it to GJ so they can say it wasn’t their call if they decide it’s not enough to act. If DA is dismissive then he gets targeted by every me too movement in the country - hot potato/political no-no

It's a little confusing....and maybe standard procedure, interested in your view. I thought all this time the Houston Police Department had the case and they were deciding if there was evidence for a criminal prosecution including interviewing the plaintiffs. But it does not appear that is what happened. There was always going to be a grand jury review once the police finished but it doesn't sound like the police are giving a recommendation at all?

Having served on a county grand jury that met every month for two years, I can say without reservation that we were heavily influenced by the evidence brought forth and the argument made by the DA to give a “true bill” of indictment.

I would estimate we true billed over 90% of the time.

If the DA decided to take the case to a Grand Jury he or she (the District Attorney) believes they have quite a bit of evidence. Enough to get charges.
