"President Trump on Wednesday said he will sign "something" intended to end his administration's controversial practice of separating children from their parents who illegally cross the southern border.

"I’ll be signing something in a little while that’s going to do that," Trump told reporters at the White House. "I’ll be doing something that’s somewhat preemptive and ultimately will be matched by legislation I’m sure."

Details about the order remain unknown.

The last few sentences of the Supreme Court's ruling explains the crux of the problem. It goes way back to policies added ad hoc over 30 years ago because Congress won't touch immigration. Still won't. I would hold Congress' feet to the fire over this. They refuse to enact reforms, and then complain about enforcement policies. They need to do their freaking job. The Supreme Court is basically screaming that this needs to be addressed by Congress (in 1997!). But in this case this is what we find.





"We think the INS policy now in place is a reasonable response to the difficult problems presented when the Service arrests unaccompanied alien juveniles. It may well be that other policies would be even better, but "we are [not] a legislature charged with formulating public policy." Schall v. Martin, 467 U. S., at 281. On its face, INS regulation 242.24 accords with both the Constitution and the relevant statute.

The judgment of the Court of Appeals is reversed, and the case is remanded for further proceedings consistent with this opinion.

It is so ordered.

The Trump EO, as reported, is going to say the children shall not be separated from their parents while the parents are being held on federal immigration charges. This goes directly against a court ruling from 2015 in addition to other bits of law/rulings.

So either the judge has got to overturn her own ruling or the EO is going to be challenged by 50 different groups.
