FOIA regarding realignment

Wouldn’t any communications conducted via email or text with the administration or Board be subject to FOIA? Surely some discussions about a prospective move have taken place via electronic Comms. But I could be wrong. Surprised we haven’t seen a reporter FOIA for such communications.

Any communications by a government supported entity using instruments paid for or supplied with gov'
funds (state or federal) are FOIA and are open to anyone to see. Unless recent changes to the law have occurred.

Thanks. That’s kind of what I thought. Seems if a reporter wanted to know what was really going on, he or she would simply FOIA the institution.

Two words - burner phones. :) Just kidding. Put in the FOI request and they'll send over the info in a couple of years post Clemson's exit to the SEC.

Yeah I reckon I hadn’t considered that. I figured there was some required turn time but I guess not. Still, one day it would be interested to see how everything unfolded behind the scenes.

attorneys are involved in this process so any such communication would be considered privileged and confidential. Just my .02 cents.

Governmental entities can also require a financial deposit and provide an estimate of the total cost of gathering the requested info., i.e. the person requesting may have to pay up front depending on the complexity of the request.
Or, they can say come in during business hours and look for it yourself and we'll assign a person at your cost to assist you.
I always preferred that approach.
No one ever chose that one.

I am sure its very, very different. But my wife is an attorney. There are always ways around things. When she is discussing aspects of a case with an expert, or their report, anything sent via mail or email is subject to discovery. If they just talk about it on thr phone, it is not subject to discovery. I always hear her telling them “ no you cant send that to me. We have to talk about it.”
