Based on the California law, why wouldn’t a 5 star recruit get an agent, and why wouldn’t that Agent call those three companies and say “My client is willing to go to Ohio State (Nike), Miami (Adidas) or Maryland (UA)...what can you offer him?”
Why wouldn’t Nike’s pitch to Clemson include the incentive program they offer to top recruits if they go to a school that uses their products?
That seems like it would happen immediately, right? I mean, wasn’t that already happening effectively in basketball despite it violating NCAA rules?

I can see Nike saying I can offer a fair endorsement contract to Ohio S mb but I'll break the bank if you come play at Oregon. My marketing department tells me that our crazy uniforms have carried us as far as they can. We need a championship to reach the next level in sales and you can be a big part of that. I'll send you a list of the other 5* players I've signed, and a list of the ones I'm going to sign. Go ducks! And all you loser teams, go duck yourselves.

Yeah . . . No. You act like Nike is a person. Nike is a corporate entity that has a fiduciary duty to the shareholders of Nike. Nike is not suddenly going to be throwing bags of money at 18 year old kids so that one of their universities, in contravention to their other universities, to win a title. It's not going to happen. Your better argument is that Phil Knight will fund athletes through other endorsements. That being said, couldn't Phil Knight have already thrown enough money for Oregon to go after a Nick Saban or Dabo Swinney or Urban Meyer?

Why worry about the university contract? If I am Adidas, I am going straight for Tua or Trevor (if it was going into effect today) and giving them a big contract. I offer a big contract give them the shoes and offer to pay all fines. Any time they are off the field they would be head to toe in Adidas gear.

Tua and Trevor are about the only two players with any kind of national appeal. Hardly anyone knows what Joe Burrow, Justin Fields, or Justin Herbert, to name a few, look like. Almost everyone knows who Tua and Trevor are. They could make some decent money, but it still must make financial (and fiduciary) sense for the apparel companies. Betting on 18 year olds is bad business.

Chicken or the egg? Nike can push a player, but there has to be a rate of return. With someone like Trevor, it's probably high.
You also have to think about the market. While TLaw is about the most recognizable college player, who is going to buy his jersey? His autograph? Clemson fans. It doesn't matter about Nike or Adidas or UA.
The bigger concern, in my eyes, is the alumni bases of some of the larger institutions having the boosters willing to fork over large sums of money to purchase jerseys and autographs of backups. That is probably not really a big concern because most highly competitive individuals aren't going to sit the bench because they are a couple thou from their jerseys.
