Clemson Releases Secondary Violations and Drug Testing Results

Twice each year Clemson releases NCAA secondary violations. The following is for the period February 1 through July 1, 2007.

2-8-07 Level of Violation: II Bylaw(s): 13.10.8 In reviewing prospective student-athlete (PSA) files, compliance services discovered that the institution publicly released the name of the PSA prior to receiving a signed NLI or offer of athletic financial aid. Head coach received letter of admonishment and received review of legislation.

2-9-07 Level of Violation: I Bylaw(s): 13.5.2.6 Assistant coach provided transportation to the family of a prospective student-athlete when transporting them from their home to Clemson for an official visit. Violation discovered by Compliance services. Assistant coach received a letter of reprimand, a review of legislation and required to attend individual monthly rules education sessions with compliance.

Prospective student-athlete declared ineligible.

3-6-07 Level of Violation: I Bylaw(s): 20.9.7.3.2 Institution failed to submit annual certified audit verifying annual football attendance prior to NCAA deadline. Violation discovered by senior administration and reported to compliance services. Outside entity completed and verified attendance.

Certified audit provided to NCAA.

3-27-07 Level of Violation: II Bylaw(s): 16.02.3, 16.11.2.2.1 On multiple occasions, former student-athlete?s father and representative of athletics interest provided free medical treatment to student-athlete. Upon returning back to campus from this medical treatment, head coach provided lodging and transportation to and from campus to student-athlete. Head coach has been relieved of duties.

Declared the student-athlete ineligible until repayment of the value to a local charity.

4-19-07 Level of Violation: II Bylaw(s): 17.26.5.2 Compliance staff was notified by the ACC office that several student-athletes exceeded the maximum number for dates of competition. In reviewing the information provided compliance confirmed that the student-athletes exceeded the maximum dates by one. Head coach believed the dual match would count as an extension of the tournament (count as a single date of competition). Head coach received letter of admonishment and a review of the legislation.

Reduce dates of competition for one returning student-athlete by two dates for 2007-08.

4-27-07 Level of Violation: II Bylaw(s): 11.7.4.3 In reviewing travel expenses, compliance services discovered a coach being replaced by another coach failed to return to campus prior to returning to recruiting activities. Assistant coach received letter of admonishment. Compliance services reviewed legislation with entire staff.

Coach reduced the evaluation of PSA by two days (one for one penalty).

5-10-07 Level of Violation: II Bylaw(s): 16.02.3 In reviewing travel expenses, sport supervisor discovered that student-athletes received breakfast per diem during the ACC tournament. The team hotel provided a full breakfast with the team?s hotel stay. Sport supervisor reported the violation to compliance services. Compliance services reviewed the teams previous travel expenses and found one additional occasion where the team received per diem while staying in a hotel that provided breakfast. Head coach issued letter of admonishment and staff received a review of legislation.

Student-athletes declared ineligible until cost of extra benefit repaid.

5-19-07 Level of Violation: II Bylaw(s): 13.1.8.9.4 In a review of recruiting expenses, compliance services discovered that a coach attended an impermissible nonscholastic activity involving prospective student-athletes. Assistant coach issued letter of reprimand.

Coach reduced 2-for-1 on the number of evaluations during the spring evaluation period.

6-14-07 Level of Violation: I Bylaw(s): 13.1.1.1.1 Assistant coach made an impermissible off campus contact with a junior prospective student-athlete. Assistant coach received letter of reprimand. Prospective student-athlete declared ineligible. Coach withheld from off campus recruiting activities for a period of two days (2-for-1 reduction).

Level I Violations: Reported directly to the NCAA as they occur. All information is on file in the office of Compliance services along with supporting documentation of repayment and letters of admonishment or reprimand.

Level II Violations: Reported directly to ACC as they occur. All inadvertent, isolated violations of the operating bylaws (NCAA Bylaws 10, 11, 12, 13, 14, 15, 16 and 17) not listed as Level I violations are considered to be Level II violations.

Drug Testing

Each summer Clemson releases drug testing results from the previous academic year. From July 1, 2006 through June 30, 2007, 433 drug tests were conducted on Clemson student-athletes. Of the samples collected, 2 (0.46%) returned positive results for marijuana. There were no positive results for other banned substances (e.g. cocaine, alcohol, steroids).
