Beat them to the punch and Trademark the whole Alphabet. That way, by owning all the letters, you would own them in the Trademark business.

It depends, .... first, the U.S. Patent and Trademark Office may require an applicant prove distinctiveness if the mark is a descriptive of a goods or service but maybe not as it can vary. Not sure if "the" qualified but it could.

Next, 31-0hio will be able to trademark the phrase for use with “education” as stated in its application to the U.S. Patent and Trademark Office. But the school likely won’t win trademark rights for the use of the phrase on anything else if someone else has trademarked 'the'. That’s because if anyone else applied to trademark “the” for use on something like T-shirts then OSU does not have it. Still, trademark rights are for from use, not applying for registration. Here is the kicker.... if any other University, who has not filed an application, started using the word "the" that other school would have the superior rights in the mark for whatever

This is the issued uOFsc ran into with USC and vice-versa. Both likely started using USC way before either trademarked it. Even if one held the trademark, they could not enforce it.


FYI, Clemson should trademark 31-0hio State as it would be a description of a service.
