and claim first use in commerce as of August 2005. Its a standard character mark (which basically means they could use it in many different ways and not limited to any particular font or style).
The application states OSU is seeking broad protection for "Clothing, namely, t-shirts, baseball caps and hats."
Their attorneys are going to make a lot of money trying to get this registered but I don't see it happening. It will get rejected but even if the application gets approved for publication, there will be numerous parties opposing the application. Imagine how many companies selling clothing, t-shirts, caps and hats have "The" in their trademark. must be many thousands. I'd say this has less than 5% chance of success for OSU but 100% chance of $$$ for their attorneys.
