Evidently you can give impermissible benefits (in the form of fake classes and grades) if some percentage of people receiving benefits are not athletes.
Sounds like a dumb loophole, but that's their argument.
The NCAA is a toothless organization.

a SACS violation or a violation with their accrediting agency which is a much bigger deal for the university as a whole than an NCAA violation. This could lead to being on probation with SACS which would be much more embarrassing to the university as a whole, and especially at one that always thought they were Ivy-League like.

UNC is also reporting new infringements every year or so, which is extending the NCAA investigation indefinitely. As long as they give free A's to normal students and continue to cheat and report it, the NCAA punishment keeps getting postponed.
