So if the girl is too drunk to remember it's not rape?

Anyone who has a daughter on here...how would you react if your daughter told you someone took advantage of them like that? I know they shouldn't be getting drunk or whatever, but somebody'd be getting an ### whipping.

Her blood alcohol level was .04.

Not to defend anyone in this deal, but that was what she tested out at later that night.

tested it was estimated her B/A level was about .1 at the time of the incident. DUI is at .08. Still not memory impaired imo. But I am not the judge.

Guess we have to know

That unless there is clear and damning evidence in a case this high profile there will be no charges.

Screw the charges, her family should deal with it.

Maybe it's just me.

Yep...there'd be a couple a well fed gators in a swamp

if that was my daughter...

On the flip side of that....

How would you feel if you had a son that was accused of a heinous crime like rape that he didn't commit? If a sexual encounter occurred but it was a he said/she said scenario and it caused your son't name to get dragged through the mud?

Exactly. Having daughters has nothing to do with it.

Posted: Dec 6, 2013 4:33 PM

I have three daughters, but I know there has to be evidence to be charged with a crime, and there is none in this case. This is one time the system seems to have worked.

bet you would change your mind if one of your daughters told you she had been raped.

Re: Exactly. Having daughters has nothing to do with it.

Posted: Dec 6, 2013 4:49 PM

What do you want pictures or just some kid to say sure I raped your daughter. Maybe the accuser's credibility was questioned I do not know her but I do know my daughter and he would have been Gator dinner a year ago.

2019 orange level memberbadge-donor-05yr.jpg

So you take the state's word over your own kid's?

Posted: Dec 6, 2013 7:01 PM

Sorry that doesn't fly with me. Rape or not, if he took advantage of her, it's his ass. Plain and simple.

but if she got drunk, and did something she was ashamed of,

Posted: Dec 6, 2013 10:01 PM

and was trying to cover it up, it was just as wrong. something is not jelling with her story or the state of florida WOULD HAVE prosecuted. the fact that they didn't tells you something was amiss.

What if he was a third string offensive tackle? Would she have been too drunk to remember his name without the 7 figure check?

Dang. Jameis does bring out the bitches.

With this definition of rape

Posted: Dec 6, 2013 10:49 PM

most of this message board would be considered rapist. As would most of the adult population.

I can't believe you honestly are arguing having sex with someone who has been drinking equals rape.

I agree, requiring evidence for rape charges

yep..the he said/she said should be heard by a jury and let them decide. And not let a FSU grad/law school grad decide.

He said/she said = no evidence.

DAs don't like taking cases they can't win.

mainly because they don't want the embarrassement of losing....not caring about the victim. In my town, we had a solicitor like that..never took cases to court unless it was outright murder...and lost most of those.

I still say let a jury decide.....that is HER right

Actually it's the accused's right.

Posted: Dec 6, 2013 5:29 PM

And the lawyers don't want to waste their time.

You're being guided by emotion here. When the case consists entirely of the alleged victim's account, without corroborating evidence, the verdict SHOULD always be not guilty.

The Evidence was in her underwear. It was reported immediately. What did she have to gain by lying about it last December. You never heard him or his lawyer say it was consensual sex until the DNA came back matching his. If that would have been the case he should have been shouting that all along. Unfortunately those 2 are the one's that truly know.

Along with someone else's "evidence". I can't help but think of this scene in Mel Brooks' "History of the World" -

I would be just as upset if my son was falsely accused. From the lack of evidence in this case, my gut tells me it was consensual. I have no way of knowing for sure just like the rest of you. The Duke Lacrosse "rape" case comes to mind.

So you would have no problem with your son

These are really the worst circumstances

Posted: Dec 6, 2013 5:03 PM

Because there is no way to know what truly happened.

It's very unfortunate if she was rapes and it is equally as unfortunate to ruin his reputation if it was consensual.

rape or no, he apparently did something so heinous to her --

Her BAC was over .10 at the time of the incident....Who knows what happened ultimately but it probably wasn't a publicity stunt....So with that said, it had to have been inappropriate conduct of some sort or buyer's remorse.

She said she was raped. He said he didn't and he has

a pervy buddy that knows this because he peeked through the door and watched it all go down. Too bad the girl didn't have an equally pervy buddy with her to tell her side of what happened. In the end, yet another he said she said where someone is going to have to live with their actions for the rest of their lives.
