New Story: Clemson tells FFRF it 'misconstrued' facts in complaint

Clemson tells FFRF it 'misconstrued' facts in complaint

Clemson University has sent an official response to the Freedom From Religion Foundation that states the foundation “misconstrued” facts when outlining a complaint against the school. What did else did Clemson's statement say and what was the response from the FFRF? Full Story »

May 2, 2014, 10:39 AM [ in reply to let me sum it up for elliot.. ]

Let's be real for anyone like FFRF who apparently doesn't know law.... in this, Clemson is the defendant. ...FFRF is attempting to be a plaintiff. Isn't it the plaintiff's job to show the beyond reasonable doubt facts or did Elliot misconstrue that too? Why does Clemson need to prove anything?

flag link military_tech thumb_downthumb_up

Yeah, I think they do get that . . .

May 2, 2014, 10:51 AM

Yeah, I think they know that and are trying to bait Clemson's counsel into spilling more facts so that they (meaning FFRF) can go on a further fishing expedition with those facts. But Clemson's legal counsel knows that and isn't taking the bait. I also think FFRF is taking advantage of the fact that much of the public doesn't understand the dynamic you pointed out, and they'll think it's only reasonable for Clemson to discuss it further.

The part of the law FFRF has a problem grasping isn't burdens of proof in a general sense, is the establishment clause in particular. They're clueless. Absolutely clueless.

It always takes two to perpetuate and argument.

Time for Clemson to simply walk away.

Political correctness is unfortunately the new chic. As for litigation, isn't that a two way street? Why couldn't Clemson sue them for defamation? Put price on these kinds of allegations.

flag link military_tech thumb_downthumb_up

If "litigation is disfavored", I am quite sure that

May 2, 2014, 6:58 AM

a counter suit would be much more so. If the Constitution separates the right of our citizens to worship in the manner they choose (or not) from government control, does Elliott want a government court to rule that our players can't exercise that right?

Why should the majority have to BOW down to the minority. That is exactly what the FFRF is, a minority. They are seeking publicity, as well as, in the long run financial gain for their group. Their legal staff contradicted themselves 2 different times in their original complaint and Clemson University answered their allegations in their response. Ignore them.

Re: New Story: Clemson tells FFRF it 'misconstrued' facts in complaint

Another interesting aspect concerning this complaint is that the FFRF doesn't have a victim or complainant. Heck, you could offer free ice cream to 100 people and you probably would have at least 5 complain. Where is the victim?
I agree that we should leave the situation as is and not respond further to the FFRF.

"What did else did Clemson's statement say"
I know it was 11:40pm not real sure how to read this other than it was late and after a long day.
Maybe this was to show and point out FFRF views
Either way thanks for being on top of this story

2024 orange level memberbadge-donor-10yr.jpg flag link military_tech thumb_downthumb_up

The letter served its purpose.

May 2, 2014, 7:22 AM

Number 1, it was a response.

Number 2, it was a short response which subtly says you don't deserve a long response as attorneys usually respond to frivolous legal claims. Clemson is not about to give them the satisfaction of a long defensive legal argument and/or justification of its actions.

Number 3, it also served to #### off and call FFRF's bluff about the matter by simply stating they "misconstrued facts" and stating nothing more. FFRF wants to argue their complaint in the press. Clemson is saying we will argue the facts elsewhere (i.e., a court of law).

Well done Clemson.

flag link military_tech thumb_downthumb_up

I wouldn't even bother with a response.***

May 2, 2014, 8:17 AM

I merely attempts to use it as a tool to slow the spread and shrink the influence of Christianity. I believe the primary purpose of the organization is to slow the spread and shrink the influence of Christianity.

FFRF: "Litigiation is disfavored." HAHAHAHA

May 2, 2014, 11:29 AM

I'm sure it is. FFRF achieves its goals by getting organizations to cave due to publicity and not wanting distractions. Any organization with the spine to stand up to them will kick them in their teeth. Groups like the ACLJ, Beckett Fund, and the Alliance Defending Freedom just drool at the prospects of getting these sniveling little whiners in a courtroom.

“We may have to monitor it through our members who follow Clemson football. We may well hear from people about the program and if it has changed. We also may hear from the university and how the scheduling of religious events will be changing.”
Monitoring through members who follow Clemson has to refer to the unwashed heathens that are #### lovers.
