Judge answers Flynn Mandamus Plea

This is a fascinating read. It's not that long.

"The unique facts of this case warrant evaluation by the trial judge before
any review by this Court.
It is unusual for a criminal defendant to claim innocence and move to
withdraw his guilty plea after repeatedly swearing under oath that he committed the crime.
It is unprecedented for an Acting U.S. Attorney to contradict
the solemn representations that career prosecutors made time and again, and
undermine the district court’s legal and factual findings, in moving on his own
to dismiss the charge years after two different federal judges accepted the
defendant’s plea."

After being placed under oath again, Mr. Flynn confirmed that (1) he
did not wish to “challenge the circumstances” surrounding his FBI interview;
(2) by pleading guilty he would be giving up “forever” his right to challenge
that interview; (3) he knew at the time of his interview that lying to the FBI
was a crime; and (4) he was “satisfied with the services provided by [his] attorneys.” Id. at 7–9. Mr. Flynn also disclaimed any reliance on revelations
that certain FBI officials involved in the interview were being investigated for
misconduct. Id. at 9.
Judge Sullivan told Mr. Flynn that he could move to withdraw his guilty
plea, that he could take a break and confer further with his
attorneys in a private room,
and that he could get a second opinion from an independent, courtappointed attorney on whether to withdraw his plea. Id. at 8–10. Despite
these offers, Mr. Flynn persisted in admitting his guilt a second time under
oath
"THE COURT: Mr. Flynn, anything else you want to discuss with
me about your plea of guilty? This is not a trick. I’m not trying to
trick you. If you want some time to withdraw your plea or try to
withdraw your plea, I’ll give you that time. If you want to proceed
because you are guilty of this offense, I will finally accept your
plea.
THE DEFENDANT: I would like to proceed, Your Honor.
THE COURT: All right. Because you are guilty of this offense?
THE DEFENDANT: Yes, Your Honor."

A lot of repubs dislike Trump's tweets and behavior, including me, but he's the only thing between me and Fascism. Biden beat Trump? You've got to be kidding. Then again, TDS has taken over what's left of your cerebral cortex. I love that Trump is living rent free in your head! Do you even realize it? Apparently not.

So, when do we debate or are you running for cover? I'll make it 100 to 1 odds. Surely you'll jump on that deal, eh?

Reading that just makes me miss Antonin Scalia’s opinions even more. Man, that guy was sharp.

I expect the response to this from DC Circuit Court of Appeals will come swiftly.

This is false. Sullivan’s hearing did not reach a detailed finding of “materiality” in Flynn’s false statements to the FBI. Sullivan talked about wanting the government to brief him on the details, the hearing was postponed, it never happened.

Sullivan didn't even sign this, he had his lawyer do it. That dumb sumbich either didn't read it, can't remember the facts of the case or he's just a liar. I'll take door number 3.

in the Washington Post that the only crime was somebody leaking the classified details of Flynn's conversations with Kislyak. I've heard more than one right-wing idiot say the same thing.

Well, the way the law works, if Flynn discussed classified information over telephone to the Russian ambassador, that would be a far more serious crime than lying to the FBI.

And the big guns at the DOJ have signed a reply to the to DC Appellate Court (which is highly unusual) undermining large chunks of Judge Sullivan's lawyer amicus brief Let that sink in. A JUDGE who supposedly RULES on the LAW, hired his own pet lawyer to write this response.

The Lead Solicitor for the US, Noel Francisco signed the DOJ's reply and it basically says there is precedent already ruled upon by the US Supreme Court undermining huge chunks of Sullivan's position. And if this d-bag DC judge wants to go to the SC, then bring it on. We're ready to embarrass this judicial clown in front of the highest court in the land.

A 3-0 ruling AGAINST Sullivan is what we should reasonably expect. BUT, given this DC - the most corrupt court system in the entire country - it will probably 2-1 against Sullivan.

IN defense of Sullivan he is likely compromised by something dark in his or his families past that has made him basically erase 100% of his legal credibility (tht is how the swamp works). He'll probably retire soon and take a gig on CNN.
