I know that figure's simply a legal parameter, but I'd think any "memorabilia" expert would value The Rock at considerably more than that.....and I don't think six figures would be out of the realm of likelihood either. No matter what those mental midgets at usuck say, The Rock is irreplaceable....we'll find out soon if its irreparable.

This is the legal definition of felony Damage to Property under the SC Code of Law. There is no parameter in the law greater than $10,000 or more. If it was valued at $437 Billion the warrant would still say the same thing.

SC Code of Law 16-11-510, excerpt:

(B) A person who violates the provisions of this section is guilty of a:

(1) felony and, upon conviction, must be fined in the discretion of the court or imprisoned not more than ten years, or both, if the injury to the property or the property loss is worth ten thousand dollars or more;

Very easy way to value it....Auction it off so someone can "own it" for a 4 year period. Put a plaque near it showing all the owners over the years. I guarantee you it will go for over $10k for the first 4 year owner!

Not sure this kid's team affiliation, but there's no way, (living in the south) that he didn't know the importance of Howard's rock. This is not a tree . Auburn has a ton of meaningless things that they say mean something. This rock is not replaceable. Frank Howard had one rock. It's not Howard's rock, because it came from death valley .CA. it's Howard's rock because it was giving as a gift to frank Howard. He didn't get two. There's no way to replace it. Like destroying the alamo and saying it was just and old building.

not singularly unique. Each tree could not be identified as being a Toomer's Corner tree solely by it's appearance. They also have a life cycle. While they have lost the original oaks, once the transplanted oaks are rooted, the uniqueness will be repaired. The Rock will always look different. Oh...and Updike has only paid $99 of the $80k, I doubt he has the ability to ever pay it.

I am having trouble understanding how the defense attorney can equate the Toomer's Corner oak tree situation with the vandalism of Howard's Rock. In the case of Howard's Rock, I believe there were two instances of "breaking and entering" when he scaled the outer fence and when he broke the plastic security case surrounding the rock.

Indeed. The longer this jerk attorney spews out things like "chattel" (which is any property not real estate, replaceable or not)in attempts to minimize what turd has done, the more he needs to be arrested and transported before a Pickens GJ.
Perhaps picked up on a warrant at 3am for the burglary with force.
Then a week or so later, pick him up at an inconvenient time to appear for possession of tools used in the commission of a crime.
Spread the hearings out. Stay on the dad, too. Exhaust his family's ability to pay the attorney.
