Sucks for Bowers. He was trying to declare a firearm in the communist state of NY and will get screwed by their firearm laws.

I'm confused... at first articles were saying it was his carry on, which is obviously not permissible. But was this a bag he was checking? It looks like he was only trying to declare it... I've done that countless times at LAX... in liberal california. And they could care less.
Also, the whole ammo thing seems kinda far reaching. Wasn't loaded, where else is he supposed to have it if he is traveling if not in the bag. Hope he gets a good lawyer.
Curious how NY law plays out at an international airport?

I've always left the magazine full when traveling with a firearm to an airport.
My two best experiences were Wyoming and Alaska. The TSA guys said "Point to which bag the firearm is in. Put this form in that bag."

Are any of you "He's carrying a loaded firearm in an airport! He's stupid, and he's a thug!" people ready to eat your words yet?
1) "Bowers was arrested at an airport ticket counter with a .40-caliber handgun" -- He was trying to check it, like people do at every airport in the country.
2) "Campbell said that there were no bullets in the gun, but there were bullets near the gun in a separate location. According to New York firearms law, if bullets are found next to the weapon, it is considered loaded." -- This is NOT a loaded weapon.
Shame on those of you who jumped to negative conclusions about this, based solely on your own prejudices.

Nope, in New York, having ammunition "near" your gun is considered the same as having a round chambered.

DaQuan did not need this to happen to him. He's lived a clean life and had many problems with injuries, father dying, etc. I hope he will have a good lawyer and that his career with the Bucks will be there when all is said and done.

I like a hunting but am not a gun enthusiast by any means and don't own any guns. That being said this is ridiculous. How is a gun loaded if there are no bullets in it?? So someone who walks around La Guardia pointing around a gun with bullets in it at people gets the same charge as someone peacefully trying to check his gun at the USAirway checkin counter that has a gun in the same bag but a different compartment then the ammo. This makes me not ever want to return to NYC.

I want to start with the Plaxico Burress situation. He had a loaded gun that fired while in a crowded night club. His plea bargin brought what should have been a minimum 42 month prison term to a 20 month sentence. Contrast that with Bowers' situation. He approaches the airline during the check-in process and informs them he has a handgun. The gun was not loaded. The clip was in a seperate area of his bag (or bags?). His intent was clear: He wanted to comply with the law and was not trying to hide or distort the truth, or circumvent the law.
I did a quick search on handgun transportation rules. The TSA gives general instructions, but clearly references state/local laws. My hope, if I'm his attorney, is that Bowers had his handgun in a locked case. I'm also hoping that the distance between his handgun and the ammo is sufficient to convince a jury that it should be considered "unloaded."
If the gun was in a case, and the ammo was not beside it, then I think the case is dismissed. I wouldn't be surprised if it gets dismissed on April 25th, if not before.
That said, C'MON MAN! ### WERE YOU THINKING, DA'QUAN?!!?
