Howard's Rock vs Toomer's Oaks

The guy who poisioned the oaks at Toomer's Corner had to pay $800,000 restitution to Auburn, got 100 days in jail and 5 years probation.

For trees that will grow back.

Last time I checked rocks don't grow back.

Injustice.

His charges brought a range of jail time between 1 and 10 years. It's a little different in the fact that the evidence in this case is only circumstantial.

Did in fact die from the poisoning. They were replaced with new oaks.

I'm assuming SC doesn't have a law as Alabama of desecration of a venerated object.

apology... isnt that the same as a confession? I got the confuse.... I guess I never realized that there was question as to who did the act.

I still dont get why/ how we let the jury determine the value of The Rock. How is that figure in question??

Felony charges were different (more punishable) than Roger's charges.

My "thoughts" are that when Rogers committed the crime there was not a legal value for The Rock.

My question is can an insurance policy establish a value?

From what Ive read recently, there was no appraisal for the Rock and thus there is no determined"legal value"


I am pretty sure you have to have an appraisal(or reciept of sale) before you get anything insured.

You want as long as you are willing to pay the premium.

Whether or not that established a value that a court of law would recognize is what I don't know.

For the record my lawyer is a Clemson WFU Grad. :)

That rock is priceless to me . It is part of what makes our deal different from everybody else's.
I know , laws and insurance appraisals and what not ...but beat and incarcerate anyone who damages that rock .
