Folly beach parking ticket question?
May 7, 2012, 10:00 AM

|
I went to folly beach this weekend with my family. It was my first time ever to Folly beach. I asked a public saftey officer before I parked if I was OK where I parked and he told me yes as long as all my tires were off the curb. Well they were all off the curb. When we were done at the beach I came back with a 50$ ticket for not being 15 feet off the curb near an intersection. I went to the folly beach public saftey office to dispute the ticket. The officer had left for the day and there was nothing I could do. I told another officer my situation and he told me he wouldn't worry about it (under his breath). So I am asking what should I do not worry about?

If they really care, they will probably mail you a letter.

I tried to go out to Folly on Saturday, I could find no parking at all. The county park being closed has really put a hurting on the situation.

to them along with a letter that says "If you try to force me to pay this ticket I will blow up your building." Then write "Bomb" in big red ink across the ticket.
That should get them off your back about that ticket.

to an intersection, stop sign, safety zone, or crosswalk. I know this because I deal with it in the City of Charleston. There are a lot of places you're not supposed to park and most people don't even realize it. It doesn't have to be marked or signed. Its just state law and therefore enforceable.
SC Code of Laws TITLE 56. MOTOR VEHICLES CHAPTER 5. UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS ARTICLE 19. STOPPING, STANDING AND PARKING
SECTION 56-5-2530. Stopping, standing or parking prohibited in specified places; exceptions. [SC ST SEC 56-5-2530]
(A) Except when necessary to avoid conflict with other traffic, or in compliance with law or the directions of a police officer or official traffic-control device, no person shall:
(1) Stop, stand or park a vehicle:
(a) On the roadway side of any vehicle stopped or parked at the edge or curb of a street.
(b) On a sidewalk.
(c) Within an intersection.
(d) On a crosswalk.
(e) Between a safety zone and the adjacent curb or within thirty feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by signs or markings.
(f) Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic.
(g) Upon any bridge or other elevated structure upon a highway or within a highway tunnel.
(h) On any railroad tracks.
(i) On any controlled-access highway.
(j) In the area between roadways of a divided highway, including crossovers.
(k) At any place where official traffic-control devices prohibit stopping.
(2) Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge passengers:
(a) In front of a public or private driveway.
(b) Within fifteen feet of a fire hydrant.
(c) Within twenty feet of a crosswalk at an intersection.
(d) Within thirty feet upon the approach to any flashing signal, stop sign, yield sign or traffic-control signal located at the side of a roadway.
(e) Within twenty feet of the driveway entrance to any fire station and on the side of a street opposite to any fire station within seventy-five feet of the entrance when properly signposted.
(f) At any place where official traffic-control devices prohibit standing.
(3) Park a vehicle, whether occupied or not, except temporarily for the purpose of and while actually engaged in loading or unloading property or passengers:
(a) Within fifty feet of the nearest rail of a railroad crossing.
(b) At any place where official traffic-control devices prohibit parking.
(B) No person shall move a vehicle not lawfully under his control into any such prohibited area or away from a curb such a distance as is unlawful.
(C) This section does not prohibit a federal postal service carrier from stopping, standing, or parking along a rural roadway for frequent short intervals during delivery of mail, parcels, or packages. As used in this section, "rural" means an area outside the incorporated areas of the county.

Appeal the ticket if they have an appeals process. Very nicely ask for an explanation of why you received the ticket because you were unaware that you were in violation and then respectfully request that the ticket be dismissed or reduced.

They always ticket cars at Folly...it could have been the owner of the property you parked on that called them to ticket you.

Throw the ticket away. Especially if you won't be going back.

You would have had your car towed, you would be fined a bazillion dollars and your 1st born and made to swim across Breach inlet.
