Can the NCAA just go ahead and ban Kansas and LSU

and any other schools whose coaches are at least on a wire or on a text/email authorizing shoe companies to pay recruits from the NCAA tourney. Those wins are going to be vacated anyway. Might as well let some schools who have done no wrong or at least haven't been caught take those spots.

They won’t because then there wouldn’t be enough teams to fill out the bracket.

deciding that non-athlete students also benefited from athletic shoes being sold at sale prices, so there's no crime. Unless it's a non-power 5 school that doesn't generate a lot of revenue for the NCAA, and doesn't have an alumni base willing to pony up major dollars for lawyer's fees.
